2 Estates Summary of the Regulations What are single use carrier bags? Which bags are exempt from the requirement to charge? When do you have an obligation to charge? What information needs to be recorded? The Carrier Bag Commitment Agenda

3 Estates 1st requirement: To charge a minimum of 5p for new single use carrier bags (paper, plastic or plant based material) 2nd requirement: If 10 or more Full Time Equivalent (FTE) staff are employed, to keep, retain and supply information on bags supplied and monies received as a result of the charge Summary of the Regulations

4 Estates Paper/plastic/starch based- included bio bags Supplied with intention to use once If Plastic o Made from thin plastic (less than 50 microns) If Paper/Starch based- Single use UNLESS o Purchased by the customer o Returnable to the retailer/Replaced free of charge - when worn out o Clearly Marked What is a single use carrier bag?

5 Estates Examples of Chargeable Bags

6 Estates Small bags can always be supplied free of charge e.g Small paper bags no greater than 175mm x 260mm - without handle or gussett - to hold greeting cards Small paper bags no greater than 150mm x 80mm – without handle but with gussett - to hold pick n mix or fulfill prescription or bought medicine from pharmacy Small flat plastic bags no greater than 125mm x 125mm - without handles - to hold small hardware items like nails, screws or buttons What bags are exempt from the requirement to charge?

7 Estates Bags of a certain size used solely to contain packaged uncooked meat, poultry and fish Bags used solely to contain exempted items e.g loose fruit and vegetables or bakery items such as croissants, dry animal food Bags of any size used to contain items purchased in airports and on board vehicles Specialist bags - courier bags for delivery of goods What bags are exempt from the requirement to charge?

9 Two situations require a charge to be made: o Where a new bag is supplied, for the purpose of enabling goods sold to be taken away (in Scotland) o Where a new bag is supplied, for the purpose of enabling delivery of goods sold - So Goods sold in Scotland and delivered to England charge to be made. Where goods are supplied by a 3rd party the obligation to charge remains with the seller When do you have an obligation to charge?

10 Estates Information to be recorded o Total number of Single Use Carrier Bags supplied o Total income received for chargeable bags o Amount received by way of the charge o A breakdown of overheads incurred o Net proceeds of the charge 1st reporting year starts on 20/10/14 and the 2nd on 7/4/15 Information must be stored for a 3 year period, starting on 31 May following the end of the reporting year in question What information needs to be recorded?

13 Estates The proceeds from the charge belong to individual businesses Scottish Government is eager to see the proceeds of the charge donated to good causes in Scotland: o Particularly those with a environmental focus To facilitate this Zero Waste Scotland will establish a voluntary agreement and associated central reporting portal Signatories will benefit from tailored communications collateral and Zero Waste Scotland aiding with both requirements to store and produce information The Carrier Bag Commitment
