3 Why a New LEP? All NSW Councils are required to prepare a Standard Template Give effect to strategic directions in Council’s settlement strategy, growth strategies and JAP

4 The process so far NSW Government released Standard LEP template in 2006 Timeframe for SRS new LEP is for completion in 2012 New Plan is a Conversion LEP informed by current strategic planning Planning Proposal adopted by Council in May Currently awaiting Gateway determination

6 The Standard Instrument LEP The new LEP must be:  Zone based  Conform with Standard Instrument format & content  Be consistent with state policies and regional strategies Mandatory provisions include:  34 zones from which to choose  Exempt and Complying Development provisions/schedules  Heritage provisions  Various clauses and map layers  Dictionary of definitions

7 The corner stones of the new Plan Conversion LEP Will give effect to recent strategic work including:  Rural living around Jindabyne and Cooma  Growth of towns and villages  Implement landuse outcomes of JAP  Updated and improved areas of environmental significance  Updated Heritage list Aims and objectives will be an amalgamation of what we have

8 The emerging conversion difficulties? No equivalent Standard zones to the eight individual localities in Rural LEP 2007 Standard definitions vary from both LEP 1997 and Rural LEP 2007 No equivalent for some uses particularly:  Tourism accommodation and uses  Rural living

9 General zone conversions (LEP 1997)  Zone 2(a) General Residential to: R2 Low Density Residential  Zone 2(b) Mixed Residential to: R1 General Residential  Zone 2(v) Village to: RU5 Village  Zone 1(c) Rural Residential to: R5 Large Lot Residential

10 General zone conversions (LEP 1997)  Zone 3(a) Business to: B2 Local Centre  Zone 4 Industrial to: IN1 General Industrial  Zone 3(b) Urban Tourist Accommodation Zone 1(d) Rural Tourist Accommodation to: Undetermined

11 General zone conversions (LEP 1997)  Zone 6 Open Space to: RE1 Public Recreation  Zone 8 National Parks and Nature Reserves to: E1 National Parks and Nature Reserves

12 Preliminary zone conversions (Rural LEP 2007)  Rural localities have no directly applicable zones, possibilities include:  Brothers-Bobundara, Berridale-Coolringdon, Dalgety-Numbla Vale localities to: RU1 Primary Production  Adaminaby-Eucumbene, Rocky Plain- Eucumbene, Moonbah-Ingebirah, Jindabyne to: RU2 Rural Landscape  Crakenback to: E4 Environmental Living

13 Feedback so far Department of Planning and Infrastructure  Bi partisan support for template  positive, supportive to work through local issues  No indication of required changes from State Agencies Community  Willingness to understand the changes  Future involvement

14 Next Steps Gateway determination will indicate specific timeframe for development of LEP, consultation requirements and further information. Continue to develop the new LEP with Council and the community with guidance from the Department. Work towards adoption and gazettal of a new plan by mid to late 2012.
