6. Dred Scott vs. Sanford Was the first application of substantive due process. Chambers vs. Florida The case was thrown out because they were not informed of their 5 th amendment right to stay silent.

7. Lucas vs. South Carolina Coastal Council The court ruled in favor of Lucas and said it was wrong for the government to take away his right to use his own land for economic gain. Hamdi vs. Rumsfeld The court overruled this case and said that just because Hamdi was cooperating with Afghanistan they couldn’t hold him as an enemy but was held as a normal citizen.
