1 I Plead the Fifth By: Briana Estrada, Abbey Lindsey, Amanda VanRooy, David Jackson

2 No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

6 Dred Scott vs. Sanford Was the first application of substantive due process. Chambers vs. Florida The case was thrown out because they were not informed of their 5 th amendment right to stay silent.

7 Lucas vs. South Carolina Coastal Council The court ruled in favor of Lucas and said it was wrong for the government to take away his right to use his own land for economic gain. Hamdi vs. Rumsfeld The court overruled this case and said that just because Hamdi was cooperating with Afghanistan they couldn’t hold him as an enemy but was held as a normal citizen.
