3  A new formula for the allocation of funds was implemented in FY2013 with the passage of “Moving Ahead for Progress in the 21 st Century Act, P.L. 112-141” (MAP-21).  A final FY 13 CR was passed at the end of March 2013, providing: ◦ The remainder of limitation (funding) for the year (including a ~0.2% rescission); and ◦ Obligation limitation of 4.1% to be applied to TTP  Sequestration did not effect TTP Program.  Full year funding percentages and shares were allocated shortly thereafter.

4  Summary of FY2013 MAP-21 TTP Formula funding: ◦ Total Authority: $450,000,000  Impact of Rescission:  $900,000 – rescission  Result - $449,100,000 available ◦ Set Asides/Takedowns:  2% for Safety, Bridge, and Tribal Planning ( Approx. $8.98 million each )  6% for Administrative Expenses ( Approx. $26.95 million )  Supplemental Funding ( $104.26 million )  80% Transition ( $277.36 million )  Result - $13.58 million for formula distribution

5  Formula factors breakdown:  Mileage:$3,668,608  Population:$5,299,100  Historic Region Formula:$4,619,728  Now obligation limitation reduction ( Approx. $18.41 million ) is applied to all factors to determine final tribal shares.

13  FY12 Inventory is used for mileage factor in new MAP-21 formula for as long as MAP-21 is in effect  Inventory updates are encouraged to continue

14  Regulation Updates: ◦ 25CFR170  Preliminary Working Draft was made available to the TTPCC for initial comment in Jan 2013.  TTPCC provided input and recommendations.  Final Draft was assembled and published in the Federal Register (April 12, 2013)  Public meetings to discuss the draft were held at three locations across Indian Country.  Received comments are being reviewed and modifications to the Rule are being made (if required). Issuance of an NPRM is anticipated in late fall.  Formal updating process will be carried out with goal to have Final Rule updated and published in Spring 2014 (FY14). ◦ Bridge (23CFR661)  A technical amendment to include MAP-21 changes to the existing Bridge Regulations is under review by FHWA.

15  BIA published a notice of consultation on draft proposed regulations on April 12, 2013  Notice, Dear Tribal Leader letter, Agenda, meeting sites, and a copy of the Draft Regulations were posted at: ◦ http://www.bia.gov/WhoWeAre/BIA/OIS/Transportation/index.htm http://www.bia.gov/WhoWeAre/BIA/OIS/Transportation/index.htm  More than 360 separate comments from more than 30 separate Tribes, tribal consortiums, tribal organizations, and other interested parties.

16  A Notice of Funding Availability (NOFA) for Tribal Transportation Program Safety Funds (TTPSF) was published in the Federal Register on August 5. This notice announces the availability of $8.6 million in funding and requests grant applications for funds in four categories:  Safety Planning;  Engineering Improvements;  Enforcement and Emergency Services; and  Education Programs.  Deadline for submissions is September 19th.  For complete instructions on preparing and submitting an application for TTPSF, please see: http://flh.fhwa.dot.gov/programs/ttp/safety/ttpsf-2013.htm  You do NOT need to register using www.sam.gov. 17  TTP Planning funds ( tribal transportation planning or 2% planning funds ) were distributed along with the tribal shares and are posted at both BIA and FHWA websites  TTP Planning: $8.6 Million  TTP Bridge funds have been allocated in accordance with procedures in 23 CFR 661  In FY 13, TTP Bridge program funded 16 bridge construction projects and 2 bridge design projects.
