Objections Used to make trials fair
Occurs when attorney violates rules of evidence You can object to: Questions the other side’s attorney is asking Answers that a witness is giving Exhibits the other side is admitting into evidence

Objection: Irrelevant
Witness’s answer, the question, or exhibit will not help the jury decide the issues in the case

Objection: Leading Question
Leading questions are one that suggest the answer to the question, usually can be answered by “yes” or “no” Only objectionable when done during direct examination

Objection: Hearsay Hearsay: statement made outside of the courtroom
Specifically- if one witness is asked to tell what another person said to him/her Exceptions: Witness can repeat a statement made by either party if it goes against their side If a person’s state of mind is important, statements made about that event regarding speakers intent, knowledge, or belief is ok

Objection: Lack of Personal Knowledge
The witness is testifying to things that the witness has not directly seen, heard, or experienced

Objection: Opinion Unless it is within the common experience of people to form an opinion of the subject, opinions are not allowed Expert witnesses are allowed to give opinions, if they explain the basis for the opinion

Objection: Argumentative Question
Cannot badger (asking again and again) or argue with the witness, can be regarding tone or manner

Objection: Speculation
Speculation: to guess at the answers Cannot ask questions that get witnesses to guess at the answers
