Legislative Branch

2 Section 1 Establishes Congress who will have all the legislative powers. Sets up the 2 parts of Congress: House of Representative Senate

3 Section 2 House of Representatives
House will be made of up Reps chosen by the people. Led by the Speaker. State pop. Determined by an enumeration every 10 yrs (Census) Serve 2 year terms Sole power to Impeach All tax law must start here!!! Elects President if no one wins Electoral College vote Requirements: 25 yrs old Citizen for 7 yrs Live in the state you represent

4 Section 3 Senate Each state receives 2 Senators and serves 6 year term
Vice President is the President of the Senate, in his absence, the President Pro Tempore steps in Senate tries all impeachment hearings Was not originally elected by the people Requirements: 30 yrs of age Citizen for 9 yrs Live in the state where elected

5 Sections 4-7 Rules Election for Reps and Senators is up to the states
Each house sets up its own rules Must keep journal of proceedings They get paid! Can’t have another civil service job How a bill becomes a law (more to come on this)

6 Section 8 Powers of Congress
Tax Borrow Money Regulate foreign and interstate trade Naturalization and bankruptcy Coin money, regulate weights and measures Punish Counterfeiting Establish post offices and roads Copyrights and Patents Establish Federal Courts ELASTIC CLAUSE!!!!!! Make all laws proper and necessary for running the govt. Punish Piracy Declare war Raise Army and Navy and provide their rules Use and control militia (Nat. Guard) Control National lands Capital National Parks

7 Section 9 Rules (more) Habeas Corpus Ex Post facto Laws
Requires our law to show “just cause” for holding a prisoner (Can it be suspended?) Ex Post facto Laws After the fact laws No taxes on items exported from states No Nobility!

8 Section 10 Limitation of the States
States CANNOT: Make treaties/alliances Coin Money Pass ex post facto laws Grant titles of nobility Tax export/import duties Make war or peace Maintain own army of navy Grant letters of Marque and Reprisals Emit bills of credit Pass bills of attainder
