Article 3(17) of Directive 2008/98/EC on waste defines ‘recycling’ and excludes “… the reprocessing into materials that are to be used … for backfilling operations”
The purpose of the new reporting item on backfilling is to increase harmonisation with the new recycling definition
Waste statistics distinguish only between two recovery codes: energy recovery (R1) and the total of all other recycling and recovery operations

Backfilling is a recovery operation where waste is used:
in excavated areas (such as underground mines, gravel pits) for the purpose of slope reclamation or safety or
as filling in landscaping or for engineering purposes on landfills
and where waste is substituting other non-waste materials which would have had to be used for that purpose
