1 Impacts of new Legislation on waste statistics
Point 6 Karin Blumenthal, E.2 DIMESA Bureau meeting 14 June 2018

2 Legislation impacted by the waste package
Packaging waste directive - Directive 94/62/EC End-of-life vehicles directive – Directive 2000/53/EC Landfill directive - Directive 1999/31/EC Waste framework directive - Directive 2008/98/EC Waste Electronic Electrical Equipment - Directive 2012/19/EU Batteries Directive - Directive 2006/66/EC Indirectly impacted: Municipal waste statistics (voluntarily - no underlying legislation)

3 Timeline of the waste package
May 2018: adoption of the amendment June 2018: publication in OJ March 2019: adoption of the implementing acts on reporting Implementation of the requirements set out in the implementing acts shall start in the first full calendar year after their adoption

4 Impacts of new waste legislation
Several implementing/delegated acts are to be drafted and adopted until March 2019 (e.g. more detailed information on methodology in new format of quality check reports, changed reporting formats) Requirement to measure food waste – data to be collected by Eurostat Several calculation rules will change (e.g. recycling, landfill targets etc.) and information on average loss rates will be required Municipal waste data collection have to be adjusted, at least in some Member States

5 Implementing act on rules to:
Deadline: 31 March 2019 Implementing act on rules to: calculate recycling and landfilling of municipal waste count biowaste separated and recycled at source count recovered metals from incinerated municipal waste calculate recycling of packaging waste count reuse of sales packaging placed on the market for the first time count repair of wooden packaging rules for counting recovered metals from packaging waste Implementing act: methodology and format to report on reuse Implementing act: reporting format waste oils Delegated act: average loss rates  Delegated act: food waste

6 Some new definitions "bio-waste" means biodegradable garden and park waste, food and kitchen waste from households, offices, restaurants, wholesale, canteens, caterers and retail premises and comparable waste from food processing plants "food waste" means all food as defined in Article 2 of Regulation (EC) No 178/2002 of the European Parliament and of the Council* that has become waste "material recovery" means any recovery operation, other than energy recovery and the reprocessing into materials that are to be used as fuels or other means to generate energy. It includes, inter alia, preparing for re-use, recycling and backfilling "backfilling" means any recovery operation where suitable non-hazardous waste is used for purposes of reclamation in excavated areas or for engineering purposes in landscaping. Waste used for backfilling must substitute non-waste materials, be suitable for the afore-mentioned purposes, and be limited to the amount strictly necessary to achieve those purposes

7 Definition of Municipal Waste
mixed waste and separately collected waste from households, including paper and cardboard, glass, metals, plastics, bio-waste, wood, textiles, packaging, waste electrical and electronic equipment, waste batteries and accumulators, and bulky waste, including mattresses and furniture; mixed waste and separately collected waste from other sources where such waste is similar in nature and composition to waste from households; Waste excluded: waste from production, agriculture, forestry, fishing, septic tanks and sewage network and treatment, including sewage sludge, end-of-life vehicles or construction and demolition waste. This definition is without prejudice to the allocation of responsibilities for waste management between public and private actors;

8 Separate collection New rules Current rules
Strengthened separate collection obligation, MS have to justify derogations MS to ensure separate collection of at least paper, metal, plastic, glass, bio-waste (by end 2023), hazardous household waste and textiles (by end 2024) MS to ensure selective demolition and sorting systems for C&D waste (material specific) Specific requirements in waste management plans Current rules Separate collection to promote high quality recycling Separate collection for at least paper, metal, plastic and glass by 2015

9 Review clauses End of 2020 Review essential requirements for packaging; Review of ELV Directive End of 2022 Set EU waste oil recovery targets End of 2023 Set EU food waste reduction targets End of 2024 Introduce additional waste prevention measures, including EU waste reduction targets Set EU preparation for re-use and recycling targets for construction & demolition waste, textile, commercial, non-hazardous industrial waste, municipal bio-waste and other waste streams. Measures to regulate, including through restrictions, waste disposal operations Review packaging waste recycling targets End of 2028 COM proposal to review 2035 MSW recycling target, including calculation rules - Review of Batteries and WEEE Directives

10 Commission’s tasks (more than 50)
End of 2018 2 DAs on food waste methodology and average loss rates 17 IAs on calculation rules and reporting of data End of 2019 2 guidelines on modulation of EPR fees and separate collection of hazardous household waste End of 2022 / 2027/2032 Early warning reports for 2025/2030/2035 targets for all MS for Waste Framework, Landfill and Packaging Directives End of 2023 / 2028 / 2032 Assessment of MS implementation reports derogating from MSW recycling, MSW landfilling and packaging targets 2020, 2022, 2023, 2024, 2028 Review clauses as in previous slide - More than 10 new and existing tasks without a deadline (including guidelines on backfilling and municipal waste definitions)

11 Impact of proposal on Own Resources in the new MFF
Plastic waste packaging own resources to be based on the data collected according to the Packaging Waste Directive Data collection will continue to be done by Eurostat Specific information requirements on data collection methodologies are likely to be formulated Country visits to check the data
