Action Reason Code Permanent removal of student by teacher from class
Permanent ban of the student by the classroom teacher from their classroom
Behavior must occur in the classroom
Teacher must document repeated behavior and deny the student to right to return their classroom

7. Non-Mandatory DAEP Action Reason Codes
Action Reason Code 10 – Non Title 5 Penal Code Felony
-Occurring off campus while the student is not in attendance at a school-sponsored or school-related activity.

Possessed, purchased, used, or accepted a cigarette or tobacco product as defined in the Health and Safety Code

Action Reason Code 59 – Serious misbehavior while expelled or placed in a DAEP

13. Non-Mandatory DAEP Action Reason Codes
Action Reason Code 41 – Fighting/Mutual Combat
Must have at least two offenders to use this code
Must not include any behavior more specifically defined (such as assault, aggravated assault, etc.)

14. Non-Mandatory DAEP Action Reason Codes
Action Reason Code 49 – Engages in deadly conduct
Action Reason Code 56 – Student is required to register as a sex offender under Chapter 62 of the Code of Criminal Procedure and is not under court supervision

15. Non-Mandatory DAEP Action Reason Codes
Action Reason Code 58 – Breach of computer security by knowingly accessing a computer, computer network, or other computer system without consent
Computer or system must be owned or operated on behalf of the school district.
Student knowingly alters, damages, or deletes school district property or information

16. Mandatory DAEP Action Reason Code
Action Reason Code 02 – Conduct punishable as a Felony
Includes offenses such as vandalism or criminal mischief where damage exceeds $1500

Action Reason Code 04 – Possessed, sold, used, or was under the influence of marijuana or other controlled substance

18. Mandatory DAEP Action Reason Codes
Action Reason Code 05 – Possessed, sold, used, or was under the influence of an alcoholic beverage
Use sub-codes (05IN, 05PO, 05SE)
Action Reason Code 06 – Abuse of glue, aerosol paint, or other such chemical
Action Reason Code 07 – Public lewdness or indecent exposure
Action Reason Code 08 – Retaliation against school employee or volunteer
Can be used whether offense occurred on campus or off campus

19. Mandatory DAEP Action Reason Codes
Action Reason Code 09 – Title 5 Felony occurring off campus and while the student is not in attendance at a school sponsored or school related activity
Action Reason Code 26 – Terroristic Threat
The student making the threat must exhibit/posses the ability to carry out the threat
The recipient of the threat must believe the threat will be carried out

20. Mandatory DAEP Action Reasons
Action Reason Code 27 – Assault against a school district employee or volunteer
There must be a victim and a perpetrator, and the victim must receive bodily injury
Action Reason Code 28 – Assault against someone other than a school district employee or volunteer.
Action Reason Code 55 – Student is required to register as a sex offender under Chapter 62 of the Code of Criminal Procedure and is under court supervision.

21. Mandatory DAEP Action Reason Code
Action Reason Code 35 – False Alarm or False Report
Examples include pulling the fire alarm, calling in a bomb threat, or giving any other false report that invokes emergency services.

22. Mandatory Expulsion ‘JJAEP’ Action Reason Codes

23. Elementary students
Students younger than 10, must receive services in DAEP if they engage in expellable behavior. [TEC37.007(e((3), (H)].
However, a student younger than 6 may NOT be sent to DAEP, unless the student brings a firearm to school. [TEC (E)(2).
Students below 3rd grade may NOT be placed in out-of-school suspensions unless the student engages in misconduct that is drug or alcohol related or that contains the elements of certain weapons offenses or violent offenses under the Texas Penal Code. [TEC ].
A district may adopt and implement a positive behavior program as an alternative to traditional discipline for students 3rd grade. [TEC ]

24. Mandatory Expulsion (JJAEP) Action Reason Codes
Action Reason Code 11 – Used, exhibited, or possessed a firearm
This does not include BB guns, pellet guns, or air- soft guns
Action Reason Code 12 – Used, exhibited, or possessed an illegal knife
Knife blade must be greater than 5.5 inches

25. Mandatory Expulsion (JJAEP) Action Reason Codes
Action Reason Code 13 – Used, exhibited, or possessed an illegal club
Many common items that are not clubs fall into this category if they are used as a club against someone (like a baseball bat or board)
Action Reason Code 14 – Used, exhibited, or possessed a prohibited weapon

26. Mandatory Expulsion (JJAEP) Action Reason codes
Action Reason Code 16 – Arson
Action Reason Code 17 – Murder, capital murder, or criminal attempt to commit murder
Action Reason Code 18 – Indecency with a child
Action Reason Code 19 – Aggravated kidnapping

27. Mandatory Expulsion (JJAEP) Action Reason codes
Action Reason Code 29 – Aggravated assault against a school employee or volunteer
Assault results in serious bodily injury to the victim 29
Action Reason Code 30 – Aggravated assault against someone other than a school employee or volunteer 30

Action Reason Code 31 – Sexual assault or aggravated sexual assault against a school employee or volunteer

Action Reason Code 36 – Felony controlled substance violation
Any amount of cocaine, meth, heroin, 4 or more ounces of marijuana, etc.
Action Reason Code 37 – Felony alcohol violation
Action Reason Code 46 – Aggravated robbery

30. Mandatory Expulsion JJAEP Action Reason codes
Action Reason Code 47 – Manslaughter
Action Reason Code 48 – Criminally negligent homicide
Action Reason Code 57 – Continuous sexual abuse of young child or children under Penal Code 21.02
Occurring on school property or while attending a school sponsored or school related activity on or off school property

31. Discipline Action Codes
Discipline Action Codes are the codes used to describe the consequences given to a student for the offense they committed.
Multiple codes may be used for each offender
For example a student may receive an out-of-school suspension (OSS) as well as a DAEP placement

32. Discipline Action Codes
Action Code 06 – In-School Suspension
Max number 30 days, 10 days consecutively
Attendance must be taken but teacher, students MAY NOT take attendance
Sign In sheets MAY NOT be used!!
Action Code 05 – Out-of-School Suspension
Can not assign a student to more than three (3) days of OSS
A partial day suspension counts as one of the three allowed

Action Code 07 – DAEP Placement
Action Code 02 – Expulsion to JJAEP
Requires a formal expulsion hearing

34. Discipline Action Code
Action Code 27 – Mandatory disciplinary action not taken as a result of ARD committee Manifestation Determination Review (MDR), made in accordance with IDEA for a student receiving special education services, that the student’s behavior is linked to the student’s disability

35. Discipline Action Code
Action Code 28 – Mandatory DAEP/JJAEP placement not taken because the district considered one or more provisions that allows the district to consider self defense, intent or lack of intent, student’s disciplinary history, or disability that substantially impairs the student’s capacity to appreciate the wrongfulness of the student’s conduct as a factor in a decision to order suspension, removal to a DAEP, or expulsion

36. Special Education Students
The placement of a student with disabilities in JJAEP, who receives special education services, may be made only by a duly constituted Admission, Review, and Dismissal (ARD) committee
Under federal rules and regulations, special education student must be allowed to continue their education program regardless of what behavior they have committed

37. If a student is given out-of-school suspension any part of a day counts as a full day for state reporting purposes
A student may not be given more than three (3) days of out-of-school suspension for any given discipline incident
If coding a student with fight/mutual combat there must be two offenders entered under one discipline incident

38. Your attendance date and discipline MUST match
Your attendance date and discipline MUST match! The state will audit this data to verify that a student in ISS/OSS is marked accordingly in attendance data. (There is a report for this!)
DATES MATTER! If the student’s placement dates change for ANY reason (more/fewer) this must be indicated on the incident in eSchool.
It will be compared to the attendance data.

For example, if you use code 21 (code of conduct violation) make sure the comments don’t say something along the lines of ‘student was caught with marijuana.’
