2 Marbury v. Madison (1803) Midnight judges from the Adams administration The Supreme Court ruled they could NOT enforce the appointment The Supreme Court established JUDICIAL REVIEW

3 McCulloch v. Maryland (1819)
Maryland was taxing a branch of the Bank of the US (BUS or National Bank) The BUS sued Maryland Supreme Court declared a state CANNOT tax a federal institution Federal government is supreme over states

4 Gibbons v. Ogden (1824) Case dealing with INTERstate trade
The Supreme Court ruled that Congress, NOT states could control interstate trade Federal government is supreme over states

5 Dred Scott v. Sanford (1857) Dred Scott, a slave, sued for his freedom
Supreme Court’s ruling? Declared that ALL African Americans were NOT citizens Slaves were deemed property, could not be taken away Congress could NOT legislate slavery in the territories - Missouri Compromise was unconstitutional Would be overturned with 13th and 14th amendments

6 Reynolds v. United States (1879)
Banned polygamy (multiple wives) Supreme Court’s impact? Not all religious practices are protected by the 1st amendment Religion does not legalize an otherwise illegal act

7 Plessy v. Ferguson (1896) Homer Plessy challenged Jim Crow laws in Louisiana What was the impact of this court case? “Separate but equal” The South focused on separate - facilities were never equal Later overturned by Brown v. Board

8 Schenck v. US (1919) Schenck spoke out against WWI and the draft, was arrested The court’s ruling? “Clear and present danger” During times of war and crisis, civil liberties decrease (connect to Lincoln’s suspension of habeas corpus during the Civil War) Upheld the Espionage Act

9 Korematsu v. US (1944) Japanese internment during WWII
Upheld the legality of FDR’s executive order of Japanese internment Fear of subversion No evidence of ANY people interred were spying Impact of court case? During times of war, rights decrease

10 Brown v. Board of Education (1954)
Declared school segregation unconstitutional Used the 14th amendment to support this What was the impact? Milestone in the Civil Rights Movement Led to Southern resistance - Southern Manifesto, Little Rock 9, Massive Resistance

11 Mapp v. Ohio (1961) Police searched Dollree Mapp’s house for a suspect, found gambling and pornographic material Did NOT have a warrant What was the impact? Incorporation of the exclusionary rule to states Can’t use illegally obtained evidence in court

12 Engle v. Vitale (1961) Supreme Court declared school sanctioned prayer unconstitutional in public schools What was the impact? Reinforced separation of church and state of the Establishment Clause Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof...

13 Gideon v. Wainwright (1963) Clarence Gideon was convicted of burglary
He could not afford an attorney, was denied one by Florida What was the impact? Incorporation of the 6th amendment (right to an attorney) for states Later became part of Miranda Rights

14 Griswold v. Connecticut (1965)
Connecticut law banning contraception was unconstitutional What was the impact? Established a “right to privacy”

15 Miranda v. Arizona (1966) Ernesto Miranda confessed to kidnapping and rape after a two hour interrogation At no time was he told he could remain silent (5th amendment) What was the impact? Incorporation of the 5th amendment Suspects must be read Miranda Rights

16 Lemon v. Kurtzman (1971) The issue? How could government $ to private, religious schools be used? What was the impact? Supreme Court stated aid may not be used to promote religion Example: $ for textbooks Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof...

17 Roe v. Wade (1973) Legalized abortion What was the impact?
One of more controversial court cases Drew on “right to privacy” established by Griswold Although there can be some restrictions, abortion is legal Planned Parenthood v. Casey (1992)

18 Regents of the University of California v. Bakke (1978)
Background: UC Davis set aside 16 admission slots for minorities - did not have to meet the same standards Bakke (white male) applied and did not get accepted, even though his scores were higher than minority candidates He sued based on discrimination Supreme Court’s Decision: Quota system could not be used Race could be considered as a factor in admission

19 New Jersey v. T.L.O. (1985) The issue?
Search and seizure of a student in a public high school What was the impact? The Supreme Court ruled that the seizure was NOT a violation of her 4th amendment rights

20 Texas v. Johnson (1989) Gregory Johnson was sentenced to a year in prison after burning the American flag What was the impact? The Supreme Court stated flag burning was supported by the 1st Amendment Very controversial case Justice William Brennan
