2 Prioritized Responsibilities Of The Legal Operations Team:
Considerations When determining the role and scope of responsibilities of your Legal Operations Team, there are several considerations to make: Size of the Law Department: The Legal Operations Team should be sized and scoped to match the Law Department they support. Instead of looking solely at the number of Legal Operations resources, consider the ratio of Legal Operations team members to the number of Law Department team members. Scope of the Law Department: The Legal Operations Team should focus their responsibilities to reflect the Law Department they support. Law Departments often include non-legal functions, such as Security, Compliance, or Environmental Impact, and the Legal Operations Team should consider those non-legal functions when determining their support focus. For example, if the Law Department includes the Compliance function, the Operations Team should consider focusing on Compliance Operations. Company Persona: The industry and company facts (e.g., company revenue, public vs. non-public) should be considered when determining the scope of the Legal Operations Team. Highly regulated industries, such as Oil & Gas and Insurance, may require additional support in the areas of Compliance and Metrics & Analytics. Highly competitive industries, such as Technology or Pharmaceuticals, may have an increased focus in Intellectual Property. Companies that are in high growth or transition mode will require different support than a company that is in steady state. Law Department Persona: The preferences and culture of the Law Department should be considered when staffing and scoping the Legal Operations Team. A Law Department with a culture of insourcing should invest in eDiscovery resources and technology to support the internal handling of sensitive information. Conversely, a Law Department that runs lean or utilizes external service providers will need Legal Operations to have a strong External Resource Management team. Technology Management is dependent on the appetite for technology in the Law Department. A Law Department with a high number of contracts will require a stronger Contract Management team.
