4 CONTEXT cont.… General Labour Rights Rights include the right to: Work
Fair remuneration and condition of service Access to training Belong to a trade union Protection of health and safety Security against unemployment or injury on duty Protection against unfair labour practice and unfair discrimination

5 CONTEXT cont.… The equal remuneration (No.100 of 1951) –set out principle of national policies on how to promote and secure equal remuneration for men and women workers for equal value. Non-discrimination in the employment relationship (No. 111 of 1958)- aim at the elimination of discrimination in the employment relationship through effective application of appropriate measures. Maternity Protection (No. 183 of 2000)- set out specific provisions to ensure health & wellbeing of a woman and her child during maternity.

6 CONTEXT cont.… Section 9(3) and (4) provide that no person may be discriminated against or dismissed on account of pregnancy. Section 22- Provides for right to freedom of trade, occupation or profession. Section 23- Right to fair labour practices. Section 24- Right to environment which is not harmful to the citizen of the Republic.

7 CONTEXT cont.… LRA- give effect to the obligations incurred by the Republic as a member state of the ILO & regulate the fundamental rights in section of Constitution. EEA- prohibits employment discrimination on the bases of race, religion or gender in the workplace. BCEA- regulates variation of basic conditions of employment. MPRDA & Mining Charter- promotes substantial & meaningful expanded opportunities for HDSA, including women in MMS. MHSA- gives effect to the public international law obligations of the Republic relating to mining health and safety ,provide for matters connected therewith.

8 CONTEXT cont.… Code of Good Practice on Pregnancy and Afterbirth- provides guideline for employers and employees on the protection of the health of women against workplace potential hazards during pregnancy ,after birth of child and while breast feeding. Code of Good Practice on Equal Remuneration for Work of Equal Value- aimed at providing practical guidance to employers and employees on how to apply the principle of equal remuneration for work of equal value in their workplace and in so doing eliminate unfair discrimination in respect of remuneration. Code of Good Practice of the Arrangement of Working Time- provides information and guidelines to employers and employees on the arrangement of working time and the impacts thereof on health , safety and family responsibilities of workers. Code of Good Practice on Sexual Harassment - aim to assist in the elimination of sexual harassment in the workplace.

16 TRIPLE CHALLENGE … Safety and security of women at mines
The disastrous unfortunate incident at Aquarius Kwezi Platinum Mine on the 09 October 2013 ,where Ms. Cynthia Setuke, was fatally injured whilst working underground. Sexual Harassment Lack of gender education Unequal & problematic gender relation Unsafe and unconducive work environment Overcrowding in the cage resulting in unwanted physical contact

17 TRIPLE CHALLENGE Interventions
Guideline for the provision of suitable PPE for women in SAMI promulgated 31/12/ ensure correct PPE is issued ito size and fit, type of workplace hazard ,nature of work to be undertaken. CIoM Instruction on protection of the safety of female employees whilst working at the mine issued on ensure more vigilant and vigorous approach on issues relating to the provision of effective safety and security measures for female employees at mines. MHSC Sexual Harassment Booklet - the prevention sexual harassment at workplace. Included in the Booklet is Toll free or for reporting purposes.
