Guiding principles in land claims Each National Park is different and hence settlement models will differ from one park to the next. Memorandum of Understanding between DEA and Department of Land Affairs and Rural Development provides for principles for the settlement of land claims in protected areas. Developmental approach to KNP settlement.

Sydney on Vaal land claim in the Vaalbos National Park Claimants opted for restoration of their claimed land. SANParks identified a new National Park The claimants were given restoration of their land without conditions. The National Park was deproclaimed and handed over to claimants. Commission on Restitution of Land Rights bought Mokala National Park as replacement of the lost National Park. This is one of the rare settlement models.

Khomani San and Mier land claim in the Kalahari Gemsbok National Park The Ae! Hai Kalahari Heritage Agreement is a tri-lateral agreement (99 years) which took effect on 28 May 2002 to establish the contractual park (Ae! Hai Kalahari Heritage Park) Managed by a Joint Management Board, represented by the Mier, Khomani San and SANParks: Implementation of the Khomani San Resource Use & Cultural Rights, 3 Way Revenue sharing agreement for !Xaus Lodge Future socio-economic benefits, e.g. the soon to be developed Auob Lodge in a 50:50 profit sharing agreement, SANParks’ donation of game to the Khomani San. SANParks is responsible for daily conservation management

Khomani San and Mier land claim in the Kalahari Gemsbok National Park Challenges: Capacity within claimant communities to manage projects. Reaching agreement on cultural resource use in the Park. Successes: Agreement in principle on cultural resource use. Development of sustainable wildlife economy project on San Land. Well functioning JMB

Makuleke land claim in Kruger National Park Land was restored to the Makuleke Community in 1999 50 year contractual agreement Review after 25 years. withdrawal of land possible on 5 year notice. JMB comprises SANParks and the Makuleke CPA. There are 3 lodge concessions on the Makuleke land with the agreement being between Makuleke CPA and the concessionaires. Makuleke CPA is responsible for projects Agricultural projects outside the Park (crops & chicken farming) Building of a primary school Eco-tourism development

Makuleke land claim in Kruger National Park Challenges: Achieving a balance between conservation and developmental issues. Communication from JMB to claimant community. Threats: The Makuleke community can withdraw their land from KNP with 5 years notice. Success: The JMB is starting to operate smoothly. Full time jobs created (70 in 3 concessions).

QwaQwa land claimants in Golden Gate Highlands NP SANParks Board has recommended alternative land and land swap in parts of GGHNP. The claimants will continue with livestock grazing in the identified land swap. Proposed settlement will include the purchase of additional land for the claimants by the Land Commission. Once the additional land has been acquired SANParks will provide game donations in order for the claimants to engage in Wildlife Economy development.

The remainder of the KNP land claims The model is based on the 2008 Cabinet Decision Alternative redress is the only option for KNP claimants No restoration of title in the Park. Phase 1 Settlement signed on 21 May 2016. Provides for financial compensation and a Beneficiation Scheme providing claimants with an interest in the business of the Park

25 KNP model Six communities have agreed to financial compensation.
R per household in lieu of improvements to land. A lump sum per claimant community in lieu of historical land value. A Beneficiation Scheme to be agreed between parties.

Beneficiation Scheme still to be approved by Board of SANParks and agreed between the parties (Claimants, DRDLR, DEA, SANParks). Will be geared towards providing claimants with an ongoing income flow as well as business and investment opportunities Proposal for 1% of tourism income from KNP to be allocated to a central claimant fund. In addition 10% of the profit of the forthcoming Skukuza Safari Lodge. Additional business opportunities e.g. game drive opportunities and equity in concessions in the KNP. 5% of the value of sales of high value species (Rhino, Buffalo).

27 Conclusion Potential exists for extending Benefit Sharing Models to other land claims. SANParks is engaging with Riemvasmaak Trust with a view to developing a Wildlife Economy initiative on Melkbosrand property at Augrabies Falls National Park. Developmental approach will be followed wherever possible in resolving land claims in conjunction with DEA and the Land Commission.
