3 Welcome In the next few minutes you will learn all you need to know about the nationally recognised Maritime Security Identification Card (MSIC). The online training portal will inform you of: What an MSIC is; Why an MSIC is important to you and your occupation: Your obligations as an MSIC Holder. To assist you in completing this online program and the MSIC Application please pay particular attention to the below items: When you have reached the final section please ensure you click the “DOWNLOAD” button on the left hand side Please ensure you bring your printed MSIC Application to your appointment IMPORTANT It is the responsibility of the MSIC Applicant to complete this training themselves. As this online program sets out your requirements under the Maritime Transport and Offshore Facilities Security Regulations 2003, failure to comply can result in fines payable by the applicant.  

4 What is an MSIC An MSIC is a nationally consistent identification card that verifies the identity of a person who has been the subject of a background check without adverse findings. The MSIC is evidence that the cardholder has met the minimum security requirements and has a verified operational need to work unescorted or unmonitored in a Maritime Security Zone. Your MSIC is: A Maritime Security Identification card; A card that belongs to the individual: A card that can be used at Ports all across Australia. Your MSIC is not: An Access Card – site specific access will be granted by the relevant terminal operator: The property of the employer. Regardless of who makes payment for an MSIC the card belongs to the INDIVIDUAL and cannot be retained by the employer if your employment ceases.

5 What is a Valid MSIC A valid MSIC is one: That is not expired;
That has been issued in accordance with the Maritime Transport and Offshore Facilities Security Act/Regulations 2003; That states the cardholders legal name; That has not been altered or defaced: That has a clear image of the cardholders face. Only authorised Issuing Bodies may issue an MSIC – the Gladstone Ports Corporation is one such authorised body. Cards are issued under advice by AusCheck and the Department of Infrastructure and Regional Development. IMPORTANT TO KNOW Your MSIC is not valid if you change your name and do not notify your Issuing Body within 30 DAYS from the date the change took place. Your Issuing Body will require you to present the relevant documentation as proof of your legal name change; Deed Poll; Marriage Certificate: Change of Name Certificate. Once this evidence is received you can apply to obtain a replacement MSIC to show your new legal name.

6 What does an MSIC cover? Once you are the holder of an MSIC you are able to have unmonitored movement within a Maritime Security Zone (MSZ). Examples of MSZ are pictured below and these can include: Port Security Zones; Landside Restricted Zone (LRZ) Waterside Restricted Zone (WRZ) Cleared Zone On-board security zones; Ship security zones: Offshore security zones.

Who needs an MSIC? An applicant must have an occupation or business related need to have unmonitored access to a maritime security zone, this is called an operational need and may include persons such as: Port, Port Facility and Port service workers; Stevedores; Transport operators such as train and truck drivers; Seafarers on Australian regulated ships: People who work on and/or supply offshore oil and gas facilities. Applicants MUST provide evidence of operational need in the form of a letter from: Your employer; A port facility with whom you are engaged: or A maritime industry participant. A Letter of Operational Need template can be found by clicking the below link. This template contains all of the information required for acceptance. 8 The MSIC? As pictured (top right), an MSIC must show the following:
The MSIC must always be displayed correctly whilst the holder is in a maritime security zone (MSZ). The correct way to display and MSIC is: Attached to the outer of your clothing; Worn above the waist; Displayed at the front or side or side of your body: The WHOLE front of the MSIC must be clearly visible. YOU ARE COMMITTING AN OFFENCE IF YOUR MSIC IS INVALID, INCORRECTLY DISPLAYED OR MISUSED IN A MSZ

9 Are you Eligible for an MSIC?
To be eligible to hold an MSIC, the Gladstone Ports Corporation as the Issuing Body needs to: ensure you have a verified operational need for an MSIC; be satisfied as to your identity; be satisfied that you are an Australian Citizen, OR have the right to work in Australia; have received advice from AusCheck (Attorney-General’s Department) as to the result of your background check and the decision of the issue of the MSIC.

10 MSIC Category’s When applying for an MSIC there are different types:
Description Period of Validity Standard MSIC This is for applicants over the age of 18 who are applying for a new MSIC or are renewing their MSIC Either 2 or 4 years as selected by the applicant Provisional MSIC This is for applicants under the age of 18 years of age at the time of the application. Set to expire 6 months after the applicant reaches 18 MSIC based on ASIC This is for applicants that hold an Aviation Security Identification Card and has already undertaken background checks by AusCheck The expiry of the MSIC will mirror the expiry of the ASIC

11 Replacement MSIC Replacement MSIC’s may be issued for one of the following reasons: Type Reason Lost/Stolen/Damaged Your card is Lost, Stolen or Damaged – This MUST be reported to the Issuing Body within 7 days of becoming aware. The MSIC holder has lost their card and makes a Statutory Declaration to that effect; The MSIC has been destroyed, damaged, altered or defaced either permanently or temporarily and the holder makes a Statutory Declaration to that effect and returns any card remnants within 30 days of receiving the replacement MSIC The MSIC has been stolen and the holder immediately reports the theft to the Police. The holder must make a Statutory Declaration concerning the circumstances of the theft including information issued by the Police or forward a copy of the police report. Change of Identity Your original MSIC must be returned to the Issuing Body within 30 days of receiving replacement The MSIC holder has changed their name through a legal process and provides evidence of this: An MSIC issued to a person who changes his or her name ceases to be valid one month after the day on which the change was made. VISA Renewal The MSIC Holder can apply for a Visa renewal MSIC if the holder has received a new Visa extension entitling them to work in Australia. The application will still require the holder to have an operational need: The replacement MSIC will not exceed the maximum 2 or 4 year period. Cancelled A cancelled MSIC can be re-issued if an applicant’s MSIC was cancelled at his or her request and is less than 12 months after the cancelation: The holder must provide evidence of operational need to hold an MSIC.

Once an application has been submitted for a criminal history check it becomes NON REFUNDABLE regardless of the outcome of the assessment.

13 The Application Process

14 Identification Requirements
Before GPC can process your MSIC application you are required, under legislation, to provide us with documents to verify your identity. A minimum of 3 documents are required (One from each category A, B and C). All documents presented to the Issuing Body must be the original Identification Category A Category B Category C Category D  A category D document is only required if the A, B or C do not display proof of your current residential address.

15 Authority to work in Australia
Australian and New Zealand Citizens will have evidence of this by supplying their passport or documentation proving citizenship. If you have an Australian Working Visa you will be required to provide evidence of this by producing: Passport with a permanent Visa (your visa will say ‘permitted to remain in Australia indefinitely’ on the label); A Visa which shows you have a ‘work rights’ status Gladstone Ports Corporation are able to verify your ‘work rights’ status. Please ensure that your details are correct within the VEVO system. When the person to whom the MSIC is to be issued is only entitled to remain in Australia because he or she holds a visa, then the expiry date will be no later than the date on which the visa expires. This means that an MSIC will be set to expire at the same time as the applicants Visa. For example: John holds a Visa for “working rights” until July 2017, he applies for a 2 year MSIC in August 2016 and this is approved. The card however will expire on the date of his Visa and not on August 2018. 16 Background Checks Once your application has been processed, by the GPC MSIC Office, it will then be submitted to AusCheck to complete the background check. Background checks are conducted by the following agencies: CrimTrac – this will check the applicants criminal history in the database of all Australian legal jurisdictions and supply a copy of the criminal record to AusCheck. This is for individuals over 18 years of age ASIO – the Australian Security Intelligence Organisation will conduct a security assessment on the applicants background and any past activities that may indicate a threat to national security. ASIO will determine if the applicant poses a politically motivated violent threat to the maritime industry. ASIO will return their assessment to AusCheck. This is for all applicants regardless of age Below is a link to the fact sheet on Maritime Security relevant offences If an adverse criminal history or security assessment is received and AusCheck make a finding that the applicant is not eligible to hold an MSIC, the applicant and Issuing Body will be notified in writing. Gladstone Ports Corporation will only receive approvals or adverse findings from AusCheck, they will not have access to any information contained within those checks. If your application is unsuccessful, AusCheck will give you written reasons as to why and will also provide you with advice on the appeals process. If you are unsuccessful in your appeal or choose not to appeal you will not be permitted to enter a maritime security zone.

17 Your Personal Information
The Gladstone Ports Corporation will only collect information that AusCheck needs in order to correctly identify you and to conduct a background check. As an example, supplying your date of birth and address information helps to ensure that AusCheck can exclude criminal records that relate to a different person with the same name as you. 18 Your Obligations As the holder of an MSIC you will have obligations under legislation that you must comply with, these include: You must notify the Gladstone Ports Corporation Issuing Body immediately if: You have a change of address or contact details You have a change of identity Your MSIC has been lost, stolen, destroyed or damaged (notify within 7 days, you will need to complete a Statutory Declaration to this effect and supply the Police Report Number if stolen) You no longer have an operational need You are convicted of a disqualifying maritime security regulated offence (MSRO) or convicted of any other MSRO and sentenced to imprisonment whilst you hold an MSIC When must an MSIC Holder return their MSIC to the issuing body: You no longer have an operational need to enter a maritime security zone; Your MSIC has been damaged, altered or defaced Your MSIC has expired – if you do not have the MSIC anymore you will need to provide a Statutory Declaration to this effect; Your MSIC has been replaced due to a name change, damaged/lost/stolen or renewed; You have been notified in writing that your MSIC has been cancelled or suspended by the Issuing Body or AusCheck. If your card has been cancelled and you return to work where you have an operational need to hold an MSIC again, and it is before the date that your card would have expired on, you will need to sign a statutory declaration stating there has been no change to your criminal record, and your card will be re-issued to you with the original expiry date. Please note a fee to re-issue the card will be payable prior to having the card printed.

19 Your Obligations – Escorting or Monitoring Visitors
As an MSIC holder, you could be asked to escort a visitor into a maritime security zone. If this occurs you are required to continuously monitor and escort the visitor whilst in the zone. Failure to correctly escort visitors can result in fines.
