1 Victoria Guidance Guidelines for Developing the Student Code of Conduct incorporating the Student Discipline Procedures 1994 and Ministerial Order No. 1, Discipline of Pupils Occupational Health and Safety Act 2004 (in effect from 1 July 2005) Section 25: Duties of employees Employees must take reasonable care for their own health and safety and for the health and safety of others who may be affected by their acts or omissions.

3 Victoria Guidance Restraint of students under regulations Regulation 22 of the Education Regulations 2000 states: “A member of the staff of a State school may take any reasonable action that is immediately required to restrain a student of the school from acts or behaviour dangerous to the member of staff, the student or any other person.”

4 Victoria Guidance The duty of care owed by a teacher to the student requires the teacher to take reasonable steps to protect students in their care from the risk of injury that could have been reasonably foreseen. This may involve disclosing personal or health information to others that the teacher feels is necessary to fulfil his or her duty of care.
