2 Stevenson-Wydler Technology Innovation Act of 1980*
To promote the United States technological innovation for the achievement of national economic, environmental, and social goals, and for other purposes Each Federal laboratory, employing 200 or more full-time equivalent scientific, engineering, and related technical positions shall establish an Office of Research and Technology Applications (ORTA). 6 Cooperative Research and Development Agreement (CRADA)
Navy Standard - agreement between a Navy laboratory and a U.S. non-Navy commercial/state or local agency/academic collaborator Research and/or development Including test and evaluation Exchange of intellectual property Within mission Well-defined role and goal in the SOW Ideally with the potential to commercialize No funding is exchanged Navy Non-Standard - agreement same as Navy Standard CRADA with one or more: Classified material Unclassified Military Critical technology Three or more collaborators Transferring funds to the Navy collaborator Transferring SBIR funds to Navy collaborator Limited Purpose - agreement restricted to the exchange of existing equipment or material that collaborators need for their own research, test, evaluation, development or engineering activities No joint work performed, used when a laboratory and *Non-Navy Collaborator have an interest in the research outcome Leverages resources Gain access to existing facilities Addresses mutual interests Lays groundwork * Non-Navy Collaborator is not a consortium or a venture capitalist, and is not controlled by a foreign company or government Statement A: Approved for Public Release. 7 SB CRADA Mechanisms CRADA with SBIR
In 2014, the Small Business Administration (SBA) SBIR Policy Directive amended its policy regarding the use of SBIR funds with a CRADA by no longer requiring a waiver. Per Section 9(e)(5) of the Policy Directive “an agency may issue an SBIR funding agreement to a small business concern that intends to enter into an agreement with a Federal laboratory to perform portions of the award or has entered into a Cooperative Research and Development Agreement (see 15 U.S.C. § 3710a(d)) with a Federal laboratory…” Restrictions are listed in Section 9(e)(5)(i) to (vi). 8 SB CRADA Mechanisms One advantage for a small business is that it may receive a license for any inventions made during the performance of the CRADA effort. Moreover, any data generated under the CRADA may be protected from public discussion for up to five years. SB working under a Phase I or II SBIR contract are now able under a CRADA to use a portion of their SBIR funding to access a Naval lab’s SME and test and evaluation capabilities. 30% Phase 1 50% Phase 2 Statement A: Approved for Public Release. 9 SB CRADA Mechanisms Use Section 219 funds to fund Federal half of CRADA A.k.a. NISE – Naval Innovation Science and Engineering NISE funds through a CRADA may contribute SSC Atlantic personnel, services and property. Call for proposals in early March each year.
