2 January 20, 1801 Adams appoints 42 Judges before leaving office (midnight appointments) Adams appoints John Marshall Chief justice of the Supreme Court William Marbury was another appointment. Adams’ the Secretary of State fails to deliver appointment

3 March 4, 1801 Thomas Jefferson takes office as President
Soon after Marbury asks Madison (Jefferson’s Secretary of State) for his appointment. Jefferson refuses to appoint Marbury.
