Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Transposition The Regulation is not fully transposed into the national legislation Ministry of Sustainable Development and Tourism shall ban production, placing on the market and use of POPs by new Law on Environment by the end of 2014 The List of pesticide allowed for use in Montenegro does not include POPs covered by this Regulation

Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Competent Authorities Ministry of Sustainable Development and Tourism is competent for the administrative tasks required by this Regulation Environmental Protection Agency collects data from a record of equipment and waste PCBs and quantities of PCB which provide the holder of equipment and also maintains LRTAP inventory for emissions into the air, Agency shall establish an inventory for releases of POPs into soil on the basis of the existing data and future assessments pesticides industrial chemicals unintentional by-products of industrial processes Ministry of agriculture and rural development Ministry of Sustainable Development and Tourism

Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation - inventories There is an inventory for emissions into the air, established in accordance with LRTAP Convention requirements, the inventory of release of POPs in water and soil does not exist yet The Environmental Protection Agency shall establish an inventory for releases of POPs into soil on the basis of the existing data and future assessments The Ministry of Agriculture and Rural Development shall amend the Law on Waters in order to include monitoring of POPs release in waters

Chapter 27: Enviroment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation Project “The Activities for the Enabling of Development the National Implementation Plan of the Stockholm Convention on Persistent Organic Pollutants in Serbia and Montenegro” number GF 4030-03-15 was signed on June 16th 2003 Cooperation Agreement was defined on March 15 th 2005 On May 21 st 2006, there was a referendum in Montenegro after which Montenegro gained independence.

Chapter 27: Enviroment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE “National Implementation Plan of the Stockholm Convention on Persistent Organic Pollutants in Montenegro” The estimation of the current condition of POPs compounds in Montenegro was given where POPs pesticides – Annex A, I part of Stockholm Convention includes : Legal regulation in the area of POPs pesticides Past, present and future production of POPs pesticides Past, present and future usage of POPs pesticides The existing stocks, waste which contains POPs pesticides, locations for the disposal and location contaminated with POPs pesticides Present capacities/potentials for testing of POPs pesticides

Chapter 27: Enviroment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation According to collected data, it can be noticed that the POPs pesticides are neither produced nor applied in Montenegro There is also no import or export of the POPs pesticides. During the inventory of the POPs pesticides, neither contaminated locations nor stock banks of the POPs pesticides were determined. There is no national program of monitoring the POPs compounds. The existing data are being collected through various monitoring programs (The program of monitoring the foodstuff of animal origin since 2007, the Program of the monitoring the dangerous and harmful substances in the soil in Montenegro since 1998) or by analyzing the inspectors’ samples

Chapter 27: Enviroment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE PCBs – Annex A, II part includes: Legal regulations in the area of PCBs Legal framework for PCBs in working environment Legally allowed PCB concentrations in certain media Import and export of PCBs The possibilities of illegal trade National capacities for PCBs monitoring Overview of locations contaminated with PCBs Experiences of the renovation of the objects infested with PCBs in Montenegro

Chapter 27: Enviroment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE No dedicated PCB National Monitoring Program is available. The current data are collected through various projects (program of monitoring of food of animal origin since 2007, program of monitoring of hazardous and harmful substances in soil in Montenegro as of 1998, monitoring program for KAP, monitoring program for surface and ground waters 1998- 2002) or analysis of samples taken by competent inspectors.

Chapter 27: Enviroment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE The laboratories are properly equipped for performing the analyses necessary. Montenegro has all the capacities required for organization of PCBs monitoring in samples of plants and plant products, food, water and soil, with partial amendments to appropriate legislation an providing of financial means.

Chapter 27: Enviroment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation The Ministry of Sustainable Development and Tourism is preparing a National Implementation Plan (NIP) for the implementation of its obligations under the Stockholm Convention The Ministry of Sustainable Development and Tourism shall publish the draft National Plan at its internet site and invite interested public to participate in the consultation process Civil society organizations are regularly involved in development of this type of documents.

The most of the required data are already available
