4 Individual with Disabilities Education Act (IDEA) IDEA protects the rights of students with disabilities in elementary and secondary schools. Covers children with disabilities from birth to age 22. All children should be provided with a free and appropriate public education (FAPE) Provides students with an Individual Education Program (IEP) Least Restrictive Environment Due Process Individual Transition Program –Transition statement should be written into the IEP by age 14.

5 Section 504 Protects individuals from discrimination Intended to “level the playing field” Civil Rights law –Having a impairment that affects one or more life activities (learning is a life activity) –Have a record of such an impairment –Regarded as having such an impairment

6 Americans with Disabilities (ADA) Civil rights law that protects individuals with disabilities ADA covers a person over their life span (Hint, this law is important to post- secondary students) Reasonable accommodations have to be made by private and public (governmental) agencies –i.e. elimination of physical barriers (ramps)

7 No Child Left Behind Act Math and Reading achievement tests given once a year between grades 3-8 Reading first guarantee School report card Disadvantaged students could have their parent or guardian transfer them to a charter or “better-performing” school Promote English Proficiency
