5 Chapter 1: Free movement of goods M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods APPLICATION OF THE EU REGULATORY FRAMEWORK IN MONTENEGRIN LEGISLATION EMC Directive 2004/108/EC  Rulebook on electromagnetic compatibility (“Official Gazette of Montenegro ", no.32/11), is consistent with the Directive 2004/108/EC  The legal basis for the adoption of the regulation is Article 6 of the Law on Technical Requirements for Products and Conformity Assessment ("Official Gazette of Montenegro", no.53/11)  Rulebook is applied from 1st January 2013  application: -Equipment and / or devices that cause electromagnetic interference and / or to which those problems may affect the way that hinder performance.  exceptions: - Radio equipment and telecommunications terminal equipment - Aeronautical products - Radio equipment used by radio amateurs -Equipment for their technical and physical characteristics can cause electromagnetic interference

6 Chapter 1: Free movement of goods M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods  Requirements to be met by electrical and other technical equipment to be supplied to the market in Montenegro  The manner and conformity assessment procedures and equipment with electromagnetic compatibility requirements,  A sign of conformity and marking of electrical and other technical equipment, and use of equipment placed on the market. Essential requirements

7 Chapter 1: Free movement of goods M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods  Defining standards relating to the requirements that equipment must meet in terms of application.  If the equipment or device meets the relevant standards which Montenegro accepted harmonized European standards, is considered to be compliant with the relevant essential requirements: - safety requirements - specific requirements for installation cannot be transferred.  The presumption of conformity is limited to the scope of the harmonized standards applied and the relevant essential requirements, which include such standards. 8 Chapter 10: Information society and media M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 10: INFORMATION SOCIETY AND MEDIA Placing on the market  Equipment can be delivered to the market if it meets the relevant technical requirements of Section 5 of this regulation, if it meets the other requirements established by this ordinance, and if properly installed, maintained and used in accordance with their intended use.  Tehničkim propisom se određuje za koje je proizvode isporučilac dužan da prije njihovog stavljanja u promet ili upotrebu obezbijedi izjavu o usaglašenosti.

9 Chapter 1: Free movement of goods M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods CE znak i način označavanja uređaja  The manufacturer or his authorized representative device which meets all the relevant essential requirements of article 5 of this Rulebook, prior to placing on the market marked with the conformity mark "CE" in accordance with the regulation.  A manufacturer or dealer shall make and with other technical documentation attached Declaration of Conformity in accordance with law and in Annex 3 (Technical documentation and declaration of conformity) which is an integral part of this Rulebook.

10 Chapter 1: Free movement of goods M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods Postupci ocjenjivanja usaglašenosti za uređaja  Conformity assessment of equipment with the essential requirements of electromagnetic compatibility of Article 5 of this Rulebook shall be, at the choice of equipment manufacturers in accordance with: - the regulations governing the procedures of conformity - Annex 1 (Internal production control) - Annex 2 (Conformity assessment procedure which includes Notified Bodies for Conformity Assessment) *Annexes are an integral part of this Rulebook.
