2 2 International Harmonization Objectives Hazardous Materials Transportation Law encourages harmonization –Enhances safety, compliance and facilitates trade –Discretion to maintain more stringent standards for safety; or to not adopt a standard due to negligible safety benefit/economic impact PHMSA promotes high transportation safety standards consistent with the HMR –Risk based and supported by data

3 3 UN Model Regulations Harmonization Status 14th Revised Edition Adopted Jan 1, 2007 in: –IMDG Code, Amdt. 33 –2007-2008 ICAO TI –U.S. HMR (Via HM-215I) –ADR/RID 15th Revised Edition Finalized Dec 2006: –Implementation schedule: January 1, 2009 –HM-215J – Final Rule in Progress 16th Revised Edition Work In Progress: –Implementation schedule: January 1, 2011 –Will be finalized December, 2008

4 4 HM 215-J Highlights (UN 15 th Revised Edition) Issues considered in HM-215J: –Excepted Quantity Provisions –Provisions for Fuel Cells –Intermediate Bulk Container (IBC) requirements

6 6 Fuel Cells New shipping descriptions added to accommodate fuel cells containing: –Hydrogen in a metal hydride –Water-reactive substances –Liquefied flammable gas –Corrosive substances

7 7 Vibration Test and Marking for IBCs Vibration test –Existing US requirement not previously required internationally, no changes proposed to US requirements New maximum permitted stacking load/do not stack marking –applies to all IBCs manufactured, repaired or remanufactured as from 1 January 2011 Minimum Size: 100 mm x 100 mm

8 Marine Pollutants We proposed to: Maintain current HMR requirements and exceptions for marine pollutants –1%/10% mixtures provision maintained Allow classification based on new criteria implemented within the IMDG Code HMR list will continue to be revised in future consistent with the listing in the IMDG Code

9 GHS Harmonization Status Physical hazard criteria aligned with GHS via HM-215I –flammable liquids –toxic materials Hazardous Substance list –Discuss with EPA –Other than aquatic toxicity Criteria for marine pollutants –IMO aligning with GHS for 2009-2010 IMDG Code –PHMSA proposed actions in 215J

10 10 Current UN Issues (16 th Revised Edition) 2007-2008 UN Work Schedule 4 Sub-Committee of Experts on the TDG meetings –31st session, July 2007 –32nd session, December 2007 –33rd session, June 30 – July 8, 2008 –34th session, December 2008 Committee of Experts on the Transport of Dangerous Goods (TDG) and on the Globally Harmonized System of Classification and Labelling of Chemicals (GHS) –4th session, December 2008 –Amendments to the 16 th revised edition of the UN Model Regulations will be approved –Comes into Force from Jan. 2011

13 13 Limited Quantities What needs to be done and why? –Harmonize documentation and marking –Simplicity/consistency –Consumer commodities would be afforded a more visible marking which would enhance safety –Reduced Costs - dual systems/remarking eliminated –Remove impediments for intl transport –Size of marking

15 Proper Shipping Names for Mixtures and Solutions Background –Ethyl Chloride Incident –ICAO Addendum –UN Working Group Goal: –Clarify how to select the most appropriate proper shipping name to enhance: Hazard identification Regulatory implications (authorized packagings etc.) Emergency response
