3. 1. Governance and transparency The Commission will moderate the meetings of the WG and provide the Secretariat Participants' contributions should: Bring in the expertise and experience of their company or organisation; while Representing association positions where that is relevant Chatham house rules Participants may speak in EN or FR (no interpretation) A website has been launched at: http://ec.europa.eu/licences-for-europe-dialogue The Commission will post there documents that it publishes in relation to Licences for Europe Stakeholders will be able to post comments on the topics covered by Licences for Europe, for consideration by the WG The WG should agree which of its working documents may also be disclosed

Schedule The WG should: Finalise work by November; and Make a mid-term report in June In function of the objectives agreed by the WG, the Commission does not exclude that: Subgroups will be established to work on specific issues or themes; and/or Open meetings with a wider group of representative businesses and organisations could or should be held on specific themes

5. 3. Objectives of this meeting Participants should state briefly their proposals on the issues identified, from a commercial and technological point of view. The objective of the WG is to explore solutions within the current legal framework. Policy debate on the current legal framework is, therefore, out of the scope of discussion On this basis, the Commission will draw conclusions summarising the orientations of the WG on: The range of specific issues to be addressed Objectives for the WG How to organise work in order to reach these objectives, including: –Subgroups as relevant –Number and regularity of meetings

6. 4. User-generated content In scope Technical, commercial and contractual issues relating to the re-use of protected material by users (UGC) Out of scope Policy positioning on the provisions of the current legal framework, including the copyright acquis and the provisions of E-Commerce Directive

7. Issues identified Much, but not all, content is licensed to platforms, including for purposes of UGC Are current licensing solutions adapted to smaller platforms? The scale and coverage of such licences is not transparent to the end user. The need or not to provide further information and therefore to enhance legal certainty to the end-users

8. Objectives for the WG Identify technical and contractual approaches to dealing with the problems identified. Specifically: Identify the extent to which user-generated content is licensed to relevant platforms (sectoral approach) Identify feasible ways to ensure that end-users are informed about what is legal and illicit use on the internet Deliver solutions to ensure that end users benefit from easier legitimate reuse of protected material

Licensing of small-scale users Scope Use of protected material by small-scale users, including for commercial purposes (SMEs) Problems identified Small-scale users of content e.g. individuals and SMEs who wish to use protected content in their websites, struggle to identify how to acquire licences, including micro-licences, for low value uses of protected content

11. Objectives The WG should identify technical and contractual approaches to dealing with the problems identified. Specifically: Identify "one-click" licensing initiatives in the EU Deliver solutions to extend the development and interconnection of such initiatives Explore the appropriateness of licensing or appropriate terms, in order to ensure that end users benefit from easier legitimate uses of protected material
