3 The Commission request to ERGEG The European Commission invited ERGEG to give advice on a legally-binding guideline concerning fundamental transparency rules by the end of 2010 Article 18 process - deviates from the normal procedure of 1) framework guideline and 2) network code Speedy process – a need for transparency rules was agreed in December 2009 Electricity Regulatory Forum  Cooperation and consulting:  Close cooperation with ENTSO-E  Early and full consultation of stakeholders To be presented by ERGEG

4 Specific points in the request to ERGEG ERGEG’s advice on fundamental data transparency should take into account: Existing requirements in the amended Annex A in Regulation 1228/2003/EC Experience gained so far The work in the Regional Initiatives Close cooperation with ENTSO-E Full recognition of ENTSO-E’s effort to create a single interface for publication of data through a common internet portal To be presented by ERGEG

5 The process 1.The establishment of a ToR-based joint group of ERGEG and ENTSO-E (technical meetings) 2.Regular meetings of the joint group with the Commission (DG ENER and DG COMP) 3.Seeking input and feedback from relevant stakeholder organisations, e.g. from EFET, EuroPEX and Eurelectric 4.Impact assessment of fundamental data transparency policy options in progress To be presented by ERGEG

8 Some challenges of the Guideline 1.All published data must be relevant to the market 2.A homogeneous definition for each data all over Europe The guideline should allow TSOs to publish data that they do not own With for instance, a binding access to some generator data, With a control mechanism that data is effectively supplied. TSOs/ENTSO-E should not be liable for data If the quickly published data is later replaced by a more accurate one That they publish but that they do not own. To be presented by ENTSO-E

9 A central pan-European transparency platform Local/regional information websites adapted to local needs INFORMATION The Guideline should anticipate on possible updates to be adapted to new market’s needs. All transparency costs must be covered. Some challenges of the Guideline To be presented by ENTSO-E

10 ENTSO-E a front-runner for a Transparent IEM Support the improvement of market transparency Actively contribute to legislation on transparency Support TSOs/ERGEG to implement transparency legislation Provide the participants of the IEM, with simultaneous homogenous and reliable data Operate, maintain and enhance the central European transparency platform, www.entsoe.netwww.entsoe.net To be presented by ENTSO-E
