REPUBLIKA SLOVENIJA MINISTRSTVO ZA OKOLJE IN PROSTOR The reform process december 2013: governmental platform adressing key challenges to be dealt with, adopted beginning of 2014: work groups formation, surveys among the administrative units, architects, engineers, investors 2014: surveys and expertise dealing with the question of illegal building works (preparation of special act on legalisation) end of 2014: new government constituted, takes forward the comprehensive reform of spatial planning and permitting, including the elements of legalisation 2015: drafting new Spatial planning act, Building code and Professions act and neccesary changes of environmental legislation, coordination with relevant stakeholders plan for 2016 and beyond: adopting new legislation

REPUBLIKA SLOVENIJA MINISTRSTVO ZA OKOLJE IN PROSTOR Key deficiencies slow processes of adopting new spatial plans new spatial plans cover complete areas of local municipalities, too determined, often very rigid, no alternative for flexibility many old spatial plans still exist, not so detailed but not up to date, no alternative for flexibility lack of integration of environmental assesment into spatial planinng and permitting procedures (separate procedures) exessively large documentation for building permit many stakeholders in the process (lack of balance) no short procedures with notifications no tolerance when executing building works ineffective inspection control/cooperation on site implementation bottlenecks

REPUBLIKA SLOVENIJA MINISTRSTVO ZA OKOLJE IN PROSTOR Main goals speeding up the adoption of new spatial plans strenghtening the coordination and balance between different stakeholders in the process flexibilisation and individualisation of spatial planning process documentation reduction for permitting process strengthening the role of local municipalities in the permitting process, new tasks for local inspections limiting possible objections against the decision for third parties complete integration of EIA gradual transition to e-permitting

REPUBLIKA SLOVENIJA MINISTRSTVO ZA OKOLJE IN PROSTOR Benefits for the investitors Fast track to the permit – propositions: -individualised spatial planning process (contractual) -integrated environmental procedures -possible discretion right for non essential derogations from the spatial planning rules in individual cases/initiatives -obligation to provide information before any procedures -optional pre-permit procedure for certain questions (reducing the investment risk) -reduced documentation for obtaining building permit -designer responsiblity for the technical part (beginning of work notification) -short procedures (for location permit and use permit under certain conditions) -e-procedures

REPUBLIKA SLOVENIJA MINISTRSTVO ZA OKOLJE IN PROSTOR Short term solutions in 2014 and 2015: 1.organisational adaptations -field of environment and spatial planning again reunited in the Ministry of the environment and spatial planning (cohesion, integration) -establishment of a new ministerial department for systemic issues in the field of environment and spatial planning responsible for cross sectoral legislative integration, harmonisation and simplification 2. bottleneck analysis in implementation of legislation and taking the necessary measures for their elimination 3. completing the establishment and full operation of Spatial information sistem, connecting all competent bodies in spatial planning procedures, permitting procedures and supervisory authorities
