City of Rehoboth Beach Managing Impacts of Current Development Trends on Residential Neighborhoods: Issues and Possible Solutions Discussion Point Five Local Contact Person From Draft Ordinance, Section 7c: During the term each Vacation Rental unit is rented, the Owner, his or her Agent, and/or the Local Contact Person designated by the Owner, shall be available twenty-four (24) hours per day, seven (7) days per week for the purpose of (1) responding by telephone to complaints from the City Police Department or other City Official and (2) responding in-person to any additional or successive complaints regarding the condition, operation, or conduct of occupants of the Vacation Rental when contacted directly by telephone of a serious violation or situation that requires immediate attention or action.

City of Rehoboth Beach Managing Impacts of Current Development Trends on Residential Neighborhoods: Issues and Possible Solutions Discussion Point Five (Continued) Local Contact Person From Draft Ordinance, Section 7e: The Owner, his or her Agent, and/or Local Contact Person, shall upon notification that any occupant and/or guest of the Vacation Rental unit has created unreasonable noise or disturbances, engaged in disorderly conduct, or committed violations of provisions of the Municipal Code or any State law, shall promptly respond in a timely and appropriate manner to prevent a recurrence of such conduct by those occupants or guests. For the purpose of this Subsection and Subsection (h) below, the following procedure shall be used to respond to identified violations or complaints: i.The use of prudent business practices to contact the occupant and/or guest by telephone for a first incident reported directly by telephone by the City Police Department or other City Official of a serious violation or situation that requires immediate attention; ii.In-person contact for a first call from the City if the occupant and/or guest cannot be reached by telephone by the Owner, Agent or Local Contact Person and for each subsequent or successive incident during a rental term; iii.The Owner, Agent or Local Contact Person shall report back to the contacting City Police Officer or City Official of the disposition and handling of the reported incident. iv.Complaints of a less serious nature will be reported the next day to the City. A notice of complaint will be ed or mailed to the Owner, Agent and Local Contact Person and also provided to the City Manager. The City Manager may follow up directly with the Owner and representative to determine disposition or resolution to the complaint or situation. v.All complaints either of a serious/immediate nature or less serious nature will result in written notice of complaint being provided to the Owner and representative. vi.Complaints will be recorded by property and information will be made part of the Vacation Rental registration file. Failure of the Owner or his or her agent to respond to calls or notice of complaints regarding the condition, operation, or conduct of occupants of the Vacation Rental in a timely and appropriate manner shall be grounds for imposition of penalties as set forth in this Chapter. It is not intended that an Owner, Agent, or Local Contact Person act as a peace officer or place himself or herself in an at-risk situation.
