European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 3 Background Result of 10 years of work by JAA and then EASA Original tasking was: Develop criteria for operations of two engines aeroplanes with diversion times exceeding 180mn; Assess the impact of the increase of range of modern 2, 3 and 4 engines aeroplanes on new long haul routes, in particular in severe climate areas; Re-arrange the provisions of GAI 20x6 (transferred into EASA AMC 20-6) according with the principles of JAR-11 (regulatory vs. advisory material); Re-distribute material in accordance with the new regulatory context of regulation n°1592/2002; Harmonise with FAA and ICAO; and; Propose a regulatory impact assessment (RIA)

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 4 Important decisions (I) Two categories of operations and relevant acronyms: ETOPS: extended twin engine operations LROPS: long range operations for 3 and 4 engines Disconnect LROPS from ETOPS: Regulating LROPS was not fully demonstrated by the RIA done for EASA and JAA. This view was also confirmed by diversion statistics for 3 of more engines aeroplanes of European register, involved in commercial air transport.

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 5 Important decisions (II) Not include recovery plans for alternate airports located in severe climate areas: Remit for the regulation of passenger recovery plans for severe climate areas within the European Community need further clarification to determine the boundaries between issues of passenger health and flight safety Take into account the existence of EU-OPS into the rulemaking plans: EASA rulemaking activities EU-OPS rulemaking activities

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 6 What is EU-OPS-1 (I) Commercial air transportation by aeroplanes Annex III of Amended Commission Regulation 3922/91 Entry into force 16 July 2008 Use of the transition period to upgrade to ‘State of the art’ of JAR-OPS Amendments were done using the ‘comitology procedure’ (Air safety Committee) EU-OPS-1 will be replaced in due course by an EASA implementing rule (Part-OPS)

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 7 What is EU-OPS-1 (II) ‘First issue’ adopted on 12 December 2006: Based on section 1 of JAR-OPS 1 at Amendment 8 ‘Second issue’ adopted on 11 December 2007: Alignment with amendments 9 to 12 of JAR-OPS 1 ‘Third issue’ to be adopted on 16 July 2008: Achieve the upgrade to ‘state of the art’ (i.e. JAA NPA-OPS in Amt.13 + JAA NPA-OPS close to finish within JAA RM process)

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 8 EU-OPS-1 rulemaking activities JAA NPA-OPS-40 extending ETOPS operations will be included in the ‘third issue’ of EU-OPS-1: Applies both to large twins and small twins:  Large/ small: small means maximum take-off mass of less than kg and maximum approved passenger configuration of less than 19 passengers  Large twins: Threshold 60 minutes  Small twins: Threshold 180 minutes Covers only operational approval requirements for ETOPS and some relevant definitions Requirements for small twins operations below 180 minutes unchanged

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 9 EASA rulemaking activities (I) NPA (ETOPS): Contents Affected CS and AMC:  CS-Definitions: incorporate 3 new definitions  CS-25, CS-E: enabling specifications  AMC to Part-21: ETOPS significant occurrences  AMC to Part-M, AMC to part 145: maintenance programmes, organisation exposition, training of personnel  AMC 20-6: Cover the design (3 sets of criteria) and operations (4 sets of criteria) 2 Regulatory impact assessments  One for large twins; one for small twins  One appendix to RIA list the differences with FAA relative to design

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 10 EASA rulemaking activities (II) Task MDM.001 ETOPS: Schedule NPA published on 6 March 2008  Comment period closes on 06 June 2008 Review of comments by Agency with review group if needed in light of comments Decision scheduled for 4th quarter 2008.

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 11 EASA rulemaking activities (III) Publication of an Advance-NPA to gather views and data on LROPS during 4th quarter 2008: Depending on the reactions, rulemaking tasks may be included into the EASA work programme Implementing rules for Air Operations: Part OPS NPA to be issued end of August 2008 Will include the same provisions as EU-OPS-1 ‘third issue’.

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 12 EASA and ICAO EASA proposed to EU-Member States to disagree with comments to ICAO state letter on extended diversion time operations (formerly ETOPS) by aeroplanes with two or more turbine engines: Reasons were outlined in slides 4 and 5 EASA has offered to participate in the Special Operations Task Force of the ICAO Air Navigation Bureau (ANB) which will analyse the provisions for ETOPS/LROPS of aircraft with more than two engines.

European Aviation Safety Agency Update on European Rulemaking for ETOPS-LROPS Slide 13 Summary-conclusions The EASA-EU ETOPS package should be adopted in 2008: Comments on NPA are encouraged. Open position on LROPS There are differences with both FAA and ICAO approaches EASA has offered to participate in the Special Operations Task Force of the ICAO.
