CROSS EXAMINATION YOU tell the story. YOU are the star.

Purpose 1.Introduce a new fact to the jury 2 Weaken or highlight a fact that has already been introduced 3. Weaken the credibility of the witness (impeach)

How to Question During Cross ALWAYS ask leading questions - State the question as a fact and have the witness commit to a yes/no answer NEVER ask a question to which you don’t know the answer Avoid complex or compound questions - Limit your questions to 5-7 words

How to Question During Cross con’t. Use simple words Do not argue with the witness Save your arguments and conclusions for the closing statement Listen to the witness’s testimony Do not ask the same questions asked during direct

When should you cross? After direct examination, you should ALMOST ALWAYS cross examine unless there has not been any unfavorable information brought out on direct.
