Making every vote count. United States Election Assistance Commission The Help America Vote Act (HAVA): HAVA was passed by the United States Congress in October 2002 to make sweeping reforms to the nation's voting process. HAVA Provided more than $3 billion to the states to improve the administration of federal elections. Marks the first time in American history that the Federal government provided funds to the States to help pay for the cost of Federal elections. Help America Vote Act (HAVA) requires voting systems must do the following: Allow the voter to review selections privately and independently before casting a ballot. Allow the voter to change selections privately and independently before casting a ballot. Notify the voter when they make more selections than permitted (over vote). Provide accessibility in minority languages for voters with limited English proficiency.

United States Election Assistance Commission U.S. Election Assistance Commission (EAC): EAC is an independent bipartisan commission created by the Help America Vote Act of 2002 (HAVA). 4 Commissioners (2D’s & 2R’s) Appointed by the President and approved by the Senate EAC’s Basic Duties Develop and adopt voluntary voting system guidelines. Test, certify, decertify, voting system hardware and software. Conduct studies to promote effective election administration. Provide guidance to States on implementation of administrative requirements. Carry out duties relating to the NVRA. Make available information regarding military and overseas voting.

United States Election Assistance Commission Technical Guidelines Development Committee Section 221 of HAVA creates the TGDC to “… assist the Executive Director of the Commission in the development of the voluntary voting system guidelines”. Section 221(e) – Technical Support from NIST Allows the TGDC to request NIST’s “technical support”. This support shall include research and development including in the areas of: Computer Security Methods to detect and prevent fraud Protection of voter privacy Human factors Remote access voting, including voting through the internet

United States Election Assistance Commission Technical Guidelines Development Committee Membership (sec. 221(c)): Director of NIST (Chair) 14 other members appointed jointly by EAC and NIST. An equal number of members from the EAC’s Standards Board, EAC’s Board of Advisors and the US Access Board. 1 - American National Standards Institute (ANSI) 1 – Institute of Electrical and Electronic Engineers (IEEE) 2 – National Association of State Election Directors (NASED) Other individuals with technical and scientific expertise relating to voting systems and voting equipment

United States Election Assistance Commission EAC Standards Board (Sec. 213) Membership 110 members representing all 50 states and the territories. 55 state election officials and 55 local election officials (1D and 1R from each state). Duties Review and comment on draft VVSG Review and comment on Management Guidelines and other best practices issued by EAC Operation 9 member executive board manages the Board EAC Exec. Director provides draft guidelines to Exec. Board for comment and submission to full board.

United States Election Assistance Commission EAC Board of Advisors Membership ( 37 members) 2 – National Governors Assoc., National Conference of State Legislatures, National Assoc. of Secretaries of State, National Association of State Election Directors, National Assoc. of Counties, National Assoc. of County Recorders, Election Administrators, and Clerks; Election Center; International Assoc. of County Recorders, Election Officials, and Treasures; United States Commission on Civil Rights; US Access Board Chief of the Office of Public Integrity US DOJ Chief of the Voting Section of Civil Rights Division, US DOJ Director, Federal Voting Assistance Program (FVAP) 4 professionals from the field of science and technology, one each appointed by the Speaker and Minority leader of US House, and the Majority and Minority leaders of the US Senate 8 members representing voter interests, with the chairs and the ranking minority members of the US House Committee on House Admin. and the US Senate Committee on Rules each appointing two members.
