The Swedish Environmental Management Council, SEMCo is a company owned jointly by the Swedish Government and the Swedish Association of Local Municipalities and Regions Competent Body for EMAS in Sweden Competent Body for the International EPD®system The Swedish Government´s expert organisation on Green and Sustainable Public Procurement Vad Miljöstyrningsrådet kan hjälpa till med Baskrav: tillhandahåller tjänster/produkter som uppfyller en basnivå av miljöprestanda. Avancerade krav: tillhandahåller tjänster/produkter i bästa miljöprestandakvartil (ca 25%). Spjutspetskriterier: tillhandahåller tjänster/produkter i frontlinjen av befintlig miljöanpassning, dvs. bygger på BAT (bästa tillgängliga teknik). Det ska finnas ett naturligt samband mellan kraven och det eftersträvade målet. Orimligt höga krav får en negativ effekt på konkurrensen eftersom de kan utesluta företag på orimliga grunder. I fallet Concordia bus ansågs det däremot inte strida mot proportionalitetsprincipen med långtgående krav. Inte ens när konkurrensen blev starkt begränsad. Detta har lett till att det går att ställa långtgående miljökrav. Inom ramen för Miljöstyringsrådets verksamhet kallas dessa långtgående miljökrav för spjutspetskriterier. likabehandlingsprincipen, Alla lev. ska ges samma förutsättningar, lika information om frågor som rör upphandlingen, samt vid samma tidpunkt. Detta gäller även vid förtydliganden av krav i förfrågningsunderlaget eller svar på frågor från leverantörer under upphandlingsförfarandet. icke-diskrimineringsprincipen, Artikel 10 EUF. - innebär att det är förbjudet att direkt eller indirekt diskriminera leverantörer på grund av nationalitet (medborgarskap, etablerings- eller verksamhetsland). Exempelvis får inte lokala företag gynnas på grund av deras geografiska läge.
