TITLE IX Title IX of the Education Amendments of 1972 is a federal civil rights law that prohibits discrimination on the basis of sex in federally funded education programs and activities. All public and private elementary and secondary schools, school districts, colleges, and universities receiving any federal financial assistance must comply with Title IX.

THE CLERY ACT The federal Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act) requires colleges and universities, both public and private, participating in federal student aid programs to disclose campus safety information, and imposes certain basic requirements for handling incidents of sexual violence and emergency situations. Disclosures about crime statistics and summaries of security policies are made once a year in an Annual Security Report (ASR), and information about specific crimes and emergencies is made publicly available on an ongoing basis throughout the year. Jeanne Clery was murdered in 1986 while a student at Lehigh University.

VIOLENCE AGAINST WOMEN ACT AMENDMENTS TO THE CLERY ACT 2014 VAWA Effective July 1, 2015 New Reporting Requirements to include: Sexual Discrimination Domestic Violence Dating Violence Stalking Modified Reporting of Hate Crimes New Student Disciplinary Procedure Requirements New Education Requirements for New Students and Employees

“One in five women, and six percent of men, are victims of completed or attempted sexual assault while in college.” DEFINITIONS Sexual violence: physical sexual acts perpetrated against a person’s will or where a person is incapable of giving consent due to the victim’s use of drugs or alcohol; intellectual or other disability. Sexual harassment: unwelcome conduct of a sexual nature. It includes unwelcome sexual advances, requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature. Domestic violence: violence by the current or former spouse or intimate partner of the victim; those with a child in common, etc. Dating violence: violence within a social relationship of romantic or intimate nature; and where existence of such a relationship shall be determined based upon designated factors. Stalking: course of conduct which would cause one to fear for personal safety or suffer substantial emotional distress.

Educational institutions are required to:  Address known incidents  Conduct investigation independent of law enforcement  Take appropriate actions  Report all incidents to Title IX Coordinator or Liaison  Confidentiality will be respected, if requested; however, this could impede investigation  Investigation will follow report of incident  Appeals to the investigation are permissible  Arrangements for physical and emotional support will be provided WE MUST REPORT!!!
