2 Why is Title IX Sexual Assault Prevention Compliance Important for Saint Mary’s College?  Recent data shows nearly 4,000 reported incidents of sexual battery and over 800 reported rapes and attempted rapes occurring in our nation’s public and private schools.*  When young women get to college, nearly 20% of them will be the victims of attempted or actual sexual assault, as will about 6% of undergraduate men.  Victims of sexual assault are more likely to suffer academically and from depression, post-traumatic stress disorder, to abuse alcohol and drugs, and to contemplate suicide. * Simon Roberts et al. 3 What is Title IX Sexual Assault Prevention?  Title IX of the Education Amendments of 1972 (Title IX), prohibit discrimination on the basis of sex in education programs or activities operated by recipients of Federal financial assistance. Enforced by the Department of Education through the Office of Civil Rights.  Sexual harassment of students is a form of sex discrimination prohibited by Title IX.  Applies to all academic, educational, extracurricular, athletic, and other school programs, whether those programs take place in a school’s facilities or at another location. 3

4 What is Sexual Harassment Violence Under Title IX?  Sexual violence refers to physical sexual acts perpetrated against a person’s will or  Where a person is incapable of giving consent due to the victim’s use of drugs or alcohol.  An individual also may be unable to give consent due to an intellectual or other disability. 4
