2 What Is Title IX Landmark civil rights protection in effect since 1972 as part of Educational Amendments to Title IX of the Civil Rights Act of 1964 Provides protection from sex-based discrimination, harassment, or gender violence at any educational institution receiving federal funding; Applies to females, males, gender non-conforming students, faculty and staff. Students are the primary focus, Title IX is applied to all campus constituencies.

3 Sex-based Discrimination is defined as: Any sex-based circumstance/event that denies or limits a student’s ability to participate in or receive benefits, services, or opportunities in the school’s programs: academic programs, internships, sports, housing, admissions, health services, etc. at East Stroudsburg University.

4 Sexual Harassment and Sexual Violence Defined 1. Harassment and Violence that is sexual in nature; 2. Harassment includes stalking, voyeurism, exhibitionism, verbal or physical sexuality-based abuse or threats thereof. 3. Violence includes intimate partner or domestic partner violence and dating violence as well as attempted or completed rape or sexual assault.

5 University Responsibilities Must appoint a Title IX Compliance Coordinator; Train campus on identifying and reporting; Advertise & maintain policies against sexual discrimination; Adopt and publish reporting and grievance procedures for the timely resolution of complaints; Must take action to assure victim/complainant can continue education free of sex discrimination, sexual harassment or sexual violence; Makes accommodations for the victim/complainant as needed/requested in areas of housing, academic, work & transportation.

6 Other Legislative Guidance Cannot guarantee confidentiality; Employees have an obligation to report; University has an obligation to investigate; Investigations can still proceed in case of an uncooperative complainant (victim); Complaint procedures must remain adequate, reliable and impartial; Investigations must conform to prompt and established timelines; Victim/complainants and accused/respondents are entitled to the presence of an advisor during hearings, notification of outcomes of complaints, and have an equal right to an appeal.
