MarriageMarriage Marriage has been recognized as a fundamental right. It is both a contract and a civil status. Marriage - Marriage - a (1) : the state of being united to a person of the opposite sex as husband or wife in a consensual and contractual relationship recognized by law (2) : the state of being united to a person of the same sex in a relationship like that of a traditional marriage {Added March, 2009}Restrictions?

Marriage Restrictions Ban on Interracial Marriages (struck down in Lovings v Virginia) Equal Protection: White Purity is a legitimate government interest? Non-discriminatory because it effects both white and black people. Due Process: No fundamental right?
