2. An initial 29 item RCC Action Plan was announced in December We are now entering the final months of the initial Action Plan. In recent Canada Gazette and Federal Register consultations, PCO/OIRA received stakeholder submissions representing 160 organizations. Canada and the US are committed to another phase of work and PCO/OIRA are considering input received with Departments. Canada and the US will develop an outline of a forward plan for regulatory cooperation by the Spring, building on progress to date and lessons learned through the implementation of the initial Action Plan. Both governments plan to engage stakeholders in the development of the next phase of work. RCC – The Way Forward

Overview of the Initiative The Regulatory Cooperation Council Marine Transport Working Group: Life Saving Appliances Work Plan includes four Action Items: 1)Development of a harmonized North American standard for lifejackets. 2)Implementation plan to approve lifejackets to the new standard. 3)Development of mutually agreed procedures for accreditation of testing laboratories. 4)Creation of a bilateral cooperative framework to ensure continued alignment.

Action Item 1 - Development of a harmonized North American standard for lifejackets Progress Update  Development of a North American standard Underwriter Laboratories (UL)12402 based on ISO is near completion: o Transport Canada Marine Safety and Security (TCMSS) and the USCG are resolving stakeholder comments on harmonized labeling requirements.  TCMSS updated stakeholders at the November 2013 National CMAC Working Group on the North American Life Jackets Standards.  Final comments to be addressed and discussed with stakeholders during upcoming PFD Task Group Meeting, hosted by the USCG in Washington on January 6-8, 2014.

6. Action Item 2 - Implementation plan to approve lifejackets to the new standard Progress Update  Implementation plan presented to stakeholders at the November 2013 National CMAC Working Group on North American Lifejacket Standards and will be reviewed during upcoming PFD Task Group Meeting: o Meeting will also discuss necessary public outreach and communications strategies.  TCMSS and USCG will continue to accept lifejackets approved to existing standards within their own jurisdiction: o Lifejackets approved to the harmonized standard will be accepted in both countries.  It is anticipated that market influences will help transition the majority of products to the harmonized standard.

Action Item 3 - Development of mutually agreed procedures for accreditation of testing laboratories Progress Update  TCMSS and the USCG agree to jointly develop an agreement on the recognition of accreditation procedure for testing laboratories.  TCMSS will incorporate harmonized standards as they are finalized into Memorandum of Understanding between TCMSS and the Standards Council of Canada (SCC): o Drafting of this MOU is in its preliminary stages. o TCMSS to move forward with communication and outreach efforts with labs and certification bodies. Issue  Regulations in the US currently require testing laboratories meet specific requirements before approval by the USCG: o Harmonized standard must move towards laboratory accreditation according to either SCC or American National Standards Institute standards, recognized equally by both countries.

8. Action Item 4 - Creation of a bilateral cooperative framework to ensure continued alignment Progress Update  Continuous alignment on the standard is now possible with the dual accreditation of one Standards Development Organization.  TCMSS and USCG Life Saving and Fire Safety Division will be finalizing terms of cooperative agreement which will outline provisions for continued alignment, focusing on future issue coordination and communication.  USCG and TCMSS coordinating with UL, CGSB, SCC, and ANSI to increase efficiencies in publishing bi-national PFD standards. Issues  Progress on the cooperative agreement can only begin once other elements of the RCC have been finalized, as this will consolidate general cooperative efforts left unaddressed or those that require further harmonization.

9. Ongoing Alignment and Next Steps  Teleconference with interested National CMAC attendees and stakeholders to discuss the agenda of PFD Task Group Meeting and develop common position, scheduled December 30,  PFD Task Group Meeting, hosted by the USCG in Washington on January 6-8: o Meeting will focus on completing the final draft of the harmonized standard UL12402 and implementation of this standard.  Finalize agreements for mutual acceptance of procedures for certification and testing.  Finalize the cooperative agreement between TCMSS and USCG for ongoing alignment.
