State Ethics & Sunshine Requirements for the Early Learning Advisory Board (ELAB) August 15, 2012

Sunshine Chapter 92, HRS In a democracy, the people are vested with the ultimate decision-making power. Governmental agencies exist to aid the people in the formation and conduct of public policy.

Sunshine (cont’d) Open meetings Every meeting shall be open to the public. Interested persons may submit written and oral input. Meeting agendas Posted on hawaii.gov calendar at least 6 days before. Once posted, agenda can only be changed with 2/3 vote of its members. Meeting ELAB has 19 members; quorum is 10. Deliberation requires quorum. Without quorum, meeting can continue for information purposes only.

Sunshine (cont’d) Permitted interactions 2 members may discuss matters relating to official business as long as no commitment to vote is made or sought. 2 or more members, but less than 10, may be assigned within defined authority to: Investigate and bring back findings. Present, discuss, or negotiate any position adopted. 2 or more members, but less than 10, may discuss matters relating to official ELAB business in the course of their participation in a workgroup or subcommittee.

Sunshine (cont’d) Interactive conference technology is allowed, provided that: It allows interaction for all members and the public. Notice of locations is provided to the public. Meeting cannot continue when audio connection is lost. (If a call-in member must leave the meeting prior to adjournment, the meeting must end upon that member's departure.) Note: The location from which a caller is phoning into the meeting becomes public and is available for public use until the meeting is adjourned. However, audio and video technology can be used to allow an ELAB member with disability to participate from a location not accessible to the public.
