DWI PENALTIES

SUSPENSION License is taken away for a required amount of time, but is returned to you at the end of that time period.

REVOCATION License is CANCELLED At the end of the revocation period, you may re-apply and re-test for your license, but that application may be denied.

PENALTIES FOR DRIVERS UNDER 21 ZERO TOLERANCE VIOLATION: (BAC 0.02%-0.07%) 1 ST Offense: License is suspended for 6 months $125 fine $100 to get license back

PENALTIES FOR DRIVERS UNDER 21 2 nd Offense: License is revoked until 21 (or 1 year) Whichever is longer

DWI CONVICTION- Driving While Intoxicated (BAC 0.08% or higher) 1 st Offense: License is revoked for 1 year $500-$1000 fine Up to one year in jail or more= FELONY

DWI CONVICTION 2 nd Offense: License is revoked until 21 (or 1 year) $1000-$5000 fine Up to 4 years in jail

For a driver's first alcohol-related offense, his or her license is suspended for 90 days. For the next two offenses, the driver's license is suspended for six months each time. New York does not require jail time after the second offense, whereas other states do.
