Form I-9 INSTRUCTIONS for FedEx Representatives Pre-Work None Action Items Complete Course Assessment via the Kelly Learning Center The purpose of this presentation is to gain consistency for all branches in the proper way the paper Form I-9 is to be completed. This will ensure compliance to the laws regulating this area. By making sure our I-9s are complete/accurate, we can save the company from serious fines, aggravation & other adverse repercussions. This training does not cover the I-9 eXpress (GEN24000w). There is a separate web-based training course (called Using I-9 eXpress) in the Kelly Learning Center. On June 6, 2008, in response to Congress's failure to put forth comprehensive immigration reform, President George W. Bush signed an amendment to Executive Order 12989 requiring all federal government contractors to agree, as a condition of entering into a federal government contract, that they will use an electronic employment eligibility verification system designated by the Department of Homeland Security (DHS) – currently E-Verify by the end of 2008. (Extended to March 2009, Corporate has deployed I-9 eXpress to all branches effective January 15, 2009.) E-Verify is an Internet-based system operated by the DHS in partnership with the Social Security Administration (SSA) that allows participating employers to verify electronically the employment eligibility of their newly hired employees. To participate, an employer must register online and accept the electronic Memorandum of Understanding (MOU) that details the responsibilities of SSA, DHS and the employer. E-Verify is free to users. Kelly is using I-9 eXpress which does have a cost associated with it.

WHAT is Form I-9? The Employment Eligibility Verification (Form I-9) is an U.S. Citizenship and Immigration Services form. All U.S. employers must complete and retain a Form I-9 for each individual they hire for employment in the United States. The form is to document that each new employee is authorized to work in the United States. SECTION 1 Kelly/FedEx temporary driver candidate or FedEx Manager can complete Section 1. If someone other than the candidate completes Section 1, that person MUST complete the Preparer and/or Translator’s section. Make sure correct version of form I-9 is used (form at www.uscis.gov) Clearly print full legal name legibly Write complete address (no PO box number or abbreviations. St. must be written as Street, Ave. must be written as Avenue, etc.) One exception to abbreviation: ONLY the state name may be abbreviated. Examples: MI, OH, IN, etc. Complete Social Security # field The Kelly/FedEx temporary driver must have a Social Security card or have applied for one. If he/she has applied for one, the Kelly/FedEx temporary driver needs to show a receipt and write “applied for” in Social Security # section. Kelly/FedEx temporary driver is required to provide Social Security Number to Kelly as soon after receiving their number as possible. SECTION 1 Ensure that the Kelly/FedEx temporary driver candidate selects the appropriate status: If the Kelly/FedEx temporary driver candidate needs assistance on the definitions, provide a copy of the I-9 Attestation form (see next slide). If the lawful permanent resident box is checked, the 9-digit Alien number (Alien #______________) must be provided. If the alien authorized to work status box is checked, the 9-digit Alien or Admission number and expiration date (if applicable), Alien # or I- 94/I94A # must be provided. SECTION 2 Kelly/FedEx representative must complete section 2. The Kelly/FedEx temporary driver candidate must provide proper documents to complete section 2. The FedEx Representative can not tell the Kelly/FedEx temporary driver candidate specially what documentation to present for verification. For a list of acceptable documents, log onto www.dhs.gov or see Slide 12. If a Kelly/FedEx temporary driver candidate does not have acceptable documents after section 1 is complete, he/she must return to provide proper documentation within three days from completing Section 1. If the Kelly/FedEx temporary driver candidate does not return within the three days, they MUST be terminated until they provide proper documentation and complete a new Form I9. NOTE: If using a typewriter to complete section 2, all information must be typed under List A or B and C. If it is not displayed correctly and Kelly Services, Inc. is audited, it could appear we are pre-populating what documents we are telling the Kelly/FedEx temporary driver candidates to provide. SECTION 2 The FedEx Representative cannot specify which documents will be accepted for verification and he/she may not review more documents than minimally required. The FedEx Representative MUST accept any document (from List A) or combination of documents (one from List B and one from List C) that meet the minimum standard, appear to be genuine and relate to the person presenting them. ORIGINAL documents MUST be provided. Exception: A receipt can be accepted for a lost, stolen or damaged SSN card. However, Kelly/FedEx temporary driver candidate MUST show actual card within 60 days. DO NOT make copies of documents presented for the I-9. Exception: The State of Colorado requires copies to be made and copies are to be stapled to the affirmation letter. DO NOT use abbreviations on any section of the I-9. Exception: State abbreviations are permitted only in the state field (example: MI for Michigan). SECTION 2 Document Title: write out complete title of document such as Michigan Drivers License, Social Security Card or United States Passport. Do not write MI DL, SS Card, or USA. Issuing authority: for driver license or state identification cards, see “state authority matrix”. For social security cards, write out Social Security Administration, not SSA. Document #: For drivers license, record all letters/number displayed on actual license. For social security card, write complete eight-digit social security number. For passport, record all numbers. Expiration date: Documents provided for List A or List B documents MUST be unexpired. That date must be recorded on I-9. List C documents may/may not have expiration date. If no date is listed, leave line blank (do not write N/A on the line). Certification date: Record the hire date of the Kelly/FedEx temporary driver or the date of the I-9 was completed. Sign and print name: FedEx Representative signs and prints his/her full name. Title: Print full FedEx title (example: Supervisor, not Sup). Business or Organization Name and Address: Print “Authorized Representative for Kelly Services”. Address: Provide the FedEx station’s address where the I-9 was completed. Date: Date in which List A, B or C documents were viewed. NOTE: Abbreviations are not allowed (example: St. must be Street). Exception: State abbreviations are permitted only in the state field (example: MI for Michigan). Suspicious DOCUMENTS If the FedEx Representative suspects the documentation presented is not authentic, inform the Kelly/FedEx temporary driver candidate: “This document on its face does not appear to be genuine. As such, I am not authorized under the law to accept it. Making corrections Do not use white-out or any other corrective materials, highlighters or staples on the I-9 form. If the Kelly/FedEx temporary driver or the FedEx Representative make an error while completing the I-9 draw one single line through the error, write the correct information next to the error and then date and initial the correction. When I-9 is completed When the FedEx Representative has completed an I-9, please do the following: Fax the I-9 form to the Kelly Services Candidate Processing Center at 1-877-397-9207. The cover sheet MUST include the following information: today's date number of pages your name your email address your phone number list of Kelly/FedEx temporary driver’s I-9(s) which are being faxed. DO NOT include social security numbers The FedEx Representative will be contacted via email if the I-9 is correct/approved or needs corrections made.
