1 New Form I-9 Regulations Effective April 3, 2009

2 Form I-9 Revisions  No changes in the process of completing Form I-9  2009 Form I-9 revisions relate only to acceptable documents

3 Revised Form I-9  CougarWeb Intranet Links, Forms, HR Forms  Previous Form I-9 is no longer valid Must use new form when employees require reverification Remember to remove old forms from existing packets  (Rev. 02/02/2009) should appear at bottom right on all pages

4 Form I-9 Revisions  All Documents must be unexpired  Documents removed from List A (These documents are no longer issued and have now expired) Temporary Resident Card Outdated Employment Authorization Cards  Documents added to List A Foreign passports containing certain machine-readable immigrant visas Valid passports for citizens of the Federated States of Micronesia (FSM) and the Republic of the Marshall Islands (RMI), along with Form I-94 or Form I-94A indicating nonimmigrant admission under the Compact of Free Association Between the United States and the FSM or RMI

5 Employer’s Responsibility  Review and ensure the employee fully and properly completes Section 1  Examine original, unexpired document(s) within employee’s first 3 days of employment  Complete and sign Section 2 within the employee’s first 3 days of employment NOTE: If employee is unable to present Section 2 documentation within his/her first 3 days of employment, he/she must stop working immediately.

6 Lists of Acceptable Documents 1 document from List A (establishes both identity & work authorization) OR 1 document from List B (establishes only identity) & 1 document from List C (establishes only work authorization) Remember: NO MORE, NO LESS

7 Restricted Social Security Cards  Today, everyone with time-limited work authorization receives a restricted Social Security card  Social Security cards that include the wording “Valid only with INS (or DHS) Authorization” or “Not Valid for Employment”  You must see other evidence of employment authorization

8 Employers Must NOT:  Specify which document(s) they will or will not accept  Refuse to hire an individual because the documents have a future expiration date  Require or accept any more documentation than the minimum necessary to meet Section 2 requirements
