Student Code of Conduct Office of Student Rights and Responsibilities This office is located on the 3rd Floor of the University Center Building The Student Code of Conduct applies to you whether you are on or off campus It is the responsibility of each ASU student to be familiar with the code of conduct Students living on campus should also be aware of housing policies To review the entire Student Code of Conduct, please visit students.asu.edu/srr students.asu.edu/srr To review all housing policies, please visit housing.asu.eduhousing.asu.edu The next few slides will review some important policies you should be aware of

Alcohol Policy All residents and guests are prohibited from possessing or consuming alcohol; or, hosting or being in the presence of others consuming alcohol in any of ASU’s residence halls or on ASU grounds. In addition, all provisions of Arizona state law regarding alcohol are in effect at all times, including but not limited to the minor in consumption (returning to the hall intoxicated), minor in possession, and public consumption laws. Devices designed for rapid consumption of alcohol (e.g., beer bongs, funnels, etc.) are prohibited and subject to confiscation. Kegs and other common source containers are prohibited. Due to health risks and the negative message sent to minors, residents are not permitted to possess/decorate their rooms with empty alcohol containers and or paraphernalia (e.g. neon signs, shot glasses, alcohol boxes, etc.). This policy includes all upper-class residential communities.

Illegal Drugs & Paraphernalia Arizona state law and university policy prohibits student involvement in the use, possession, distribution, presence of or sale of illegal drugs and/or paraphernalia. The most common violation of this policy in housing is the possession and smoking of marijuana. Marijuana is an illegal drug under Arizona State Law and thus is prohibited. ASU Police are called each time there is suspicion of marijuana use. Students living on campus are held accountable through the university conduct process and also through the Arizona state legal system. Violation of this law may impact a student’s ability to study abroad while at the university and obtain employment at the university or in their field of study. Some careers that require a license, such as teaching, may deny the ability to get a license due to violation of this law. Students with legal medical marijuana cards may NOT possess or use marijuana on campus.

Threats/Threatening Behavior The university takes issues of threats or threatening behavior towards others and oneself very seriously. Endangering, threatening, or causing physical harm to any member of the university community or to oneself, causing reasonable apprehension of such harm or engaging in conduct or communications that a reasonable person would interpret as a serious expression of intent to harm are all prohibited forms of threats or threatening behavior. Immediate and severe action will be taken to remove the aggressor from the situation, whether it be removal from a residence hall or all of campus, and also to protect the victim. The person making the threat may face temporary suspension while the case is investigated. If you have knowledge of a threat that was expressed, please contact hall staff immediately or call ASU Police.

Fire Emergency & Safety Residents and their guests are expected to promptly evacuate the building whenever a fire alarm sounds and to observe all fire/emergency guidelines. Hall specific fire evacuation procedures are outlined within your room or at your front desk. Whether accidental or intentional, the misuse, damage and/or tampering with fire/emergency equipment (such as fire pull boxes, fire extinguishers, fire doors, fire hoses, smoke detectors, and sprinkler systems) is strictly prohibited and will result in behavioral, student conduct and/or criminal action. Tampering with or disabling fire equipment and smoke detectors are a felony in the state of Arizona. Residents are encouraged to confront individuals disregarding this policy and to report the incident to their hall staff. Emergency Notification System ASU has established a two-tier communication system, ASU Alert and ASU Advisory, to notify the ASU community about emergency situations that could happen on any of the four campuses in the most efficient and effective manner possible. ASU strongly encourages you to sign up for these services to ensure you receive appropriate communications about both life-threatening and potentially hazardous situations. ASU Alert communicates primarily life-threatening situations to the ASU community through a variety of methods, including text messaging. ASU Alert also may be used to notify the community of a major emergency that greatly impacts university operations. By signing up for this service, you will know about an incident in the most immediate fashion. Situations include a major fire or incident involving a firearm on and around campus. ASU Advisory is considered a tier below ASU Alert and communicates situations to the ASU community that may not be life-threatening and typically affect certain areas of a campus. Examples include a small fire in a building during off hours or flooding in a building that will affect classes that day. ASU Advisory messages are sent through a variety of methods, including text messaging. By signing up for this service, you will know about these situations in the most immediate fashion.

ASU Police ASU Police Officers are state certified, and have the same powers as any police officer in the State of Arizona. All police officers in the State of Arizona, including ASU police officers, have the authority to enforce state and federal laws within limits imposed by the state and federal constitutions and judicial rulings. ASU Police Aides: Police Aides are the “non-sworn” branch of the police department which functions much like the sworn branch in many regards. Police Aides wear a department uniform, carry a radio and are an integral part of helping to assure the safety of students, staff, faculty, and visitors to ASU. Personal Safety Tips Walk in well lit areas & with others Be aware of your surroundings Know the location of emergency call boxes Police Escort Service: Always keep your door locked, especially when leaving your room Get to know the students living around you Report any and all suspicious activities

Protecting Property Always keep your doors locked Do not let others in your room unescorted Do not leave valuables in plain view Do not prop community gates and doors Report a lost/stolen room key immediately Do not give your room key or ID card to someone else to use

Crime Reporting If you witness a crime in progress call 911 immediately. -Here are the basics that you will need to know:  Location  Crime  Description of subjects involved  Your name  Your contact information NOTE: Most 911 cell phone calls will go directly to the Phoenix or Glendale Police Departments. Let them know you are on an ASU campus so they can transfer the call to our dispatch If you are a victim of a crime please contact ASUPD at to file a report

Common Violations: Alcohol If students are confronted by ASU Police or other law enforcement agencies regarding alcohol, they might receive one of the two following citations: Minor in Possession (MIP): Being under the age of 21 in possession of alcohol Minor in Consumption (MIC): Being under the age of 21 with any trace of alcohol. Common Violations: Drugs & Paraphernalia Any useable quantity of any illicit drug is a FELONY in the State of Arizona NOTE: This includes illegal use of prescription drugs Drug paraphernalia is any item used in conjunction with an illegal drug Medical Marijuana: Even if you have a Medical Marijuana Card (MMC) you can still be arrested depending on where you acquired the Marijuana from. Possession of an MMC does not allow you to possess or use marijuana in ASU housing nor on campus. It also does not mean you are allowed to share your marijuana with others.

Weapons Weapons on college campuses are taken very seriously Weapons may include but are not limited to: Knives Paint/Air/Stun/Co2/Pellet/Spring Guns Tasers Martial Arts weapons Mace Laser pointers Tear Gas Sling Shots

What is “Consent”? Verbal agreement to engage in sexual activity Silence does not mean "yes” Must be given by a sober, conscious individual Must be given freely, with no emotional or physical force Consent to one act of sex does not mean consent to all acts of sex A person is incapable of consent if he or she is: Mentally disordered Drug impaired Alcohol impaired Sleeping Has any other impairment of cognition

Sexual Violence Sexual Assault = Any sexual contact without consent Attempted or completed non-consensual sexual act Touching Anal, oral, or vaginal penetration Threats of rape

If you are sexually assaulted Find a safe place Preserve evidence of the assault You can choose to report the assault to the police.
