2 The Clery Act Jeanne Clery was a freshman student at Lehigh University in Pennsylvania in 1986. April 5, 1986 – She was raped and murdered in her residence hall by a fellow student who was burglarizing rooms. Her family campaigned for more awareness of crimes that occur in and around college campuses. In 1990, The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act or the Clery Act was signed into federal law.

3 Requirements of the Clery Act Annual Security Report  Includes Statements of Policy and Campus Crime Statistics  Emergency Notifications; Timely Warnings; and a publicly accessible Crime Log U. S. Department of Education enforces the Clery Act  Violators subject to fines beginning at $35,000 and the loss of current and future financial aid funds

4 Reporting Crime Under the Clery Act It is important to understand that a victim of a crime may be more inclined to report the crime to someone other than law enforcement, to include campus police. The Clery Act requires all institutions to collect crime reports from a variety of individuals and organizations that are considered by the Act to be “Campus Security Authorities.”

5 Campus Security Authorities-defined The Clery Act defines FOUR categories of Campus Security Authorities: 1. Campus Police & Security Personnel 2. Individuals responsible for safety but are not campus police or security, student escorts, student security, parking monitors 3. Officials of institutions who have “significant responsibility for student campus activities”, e.g. Coaches, Trip Advisors 5. Individuals designated under school policy as individuals to whom to report crimes, e.g. Judicial Affairs, Dean of Students

6 When Do Crimes Need to be Reported Under the Clery Act? If a victim calls it to your attention If a witness or third party calls it to your attention  Note—CSAs are only required to report what they were told, not overhears.

7 What crimes need to be reported under the Clery Act? Criminal Homicide Murder, Non-negligent manslaughter, manslaughter by negligence Sex Offenses Rape, Fondling, Incest, Statutory Rape Robbery Aggravated Assault Burglary Motor Vehicle Theft Arson

8 Additional Reportable Crimes Arrests & Disciplinary Referrals Liquor Law Violations Drug Law Violations Illegal Weapons Possession Hates Crimes Defined as a criminal offense against a victim who was specifically targeted because of his/her being a member of one of these protected classes (race, religion, sexual orientation, gender, gender identity, ethnicity, national origin, and disability Includes all crimes on previous slide, if motivated by bias, and… Larceny-Theft, Simple Assault, Intimidation, and Destruction/Damage/Vandalism of Property

10 Clery Geography Clery Act Crime Statistics will be counted when they occur in the following areas: On- Campus In Residence Halls on campus that are owned or leased by the Institution On Public Property immediately adjacent to campus property Sidewalk + Street + Sidewalk On Non-Campus Property Owned or Controlled by institution Greek Housing, Remote Classrooms, Study Abroad Locations

11 Who is a CSA? Professional staff in Student Affairs & Residence Life Student Activities Center Staff Faculty or Staff Advisors to student organizations Resident Assistants Coaches

12 Who is not a CSA? A faculty member who does not have responsibility for student or campus activities beyond the classroom. Clerical Staff Cafeteria Staff Facilities & Maintenance Staff

13 Privileged Communication Exemption There are two types of individuals who are exempt from Clery reporting obligations: – Pastoral Counselors – Professional Counselors

14 What Must a CSA Report? Type of Crime Location of Crime Timing  Date and time the incident occurred  When the incident was reported to you

15 Key Points to Remember A Campus Security Authority (CSA) is not responsible for determining whether a crime took place- that is the function of law enforcement. If you are not sure whether the crime needs to be reported, share the information anyway.
