Licensing Committee Consultation 2014

  Changes to the Licensing Act 2003  To give clearer guidance to residents and applicants on:- The links between the planning and licensing regimes Enforcement procedures & premises inspection Applications from garage forecourt shops The handling of personal details of those making representations The suspension of licences for non payment Reasons for Change

  Spring 2014 – Officers prepared draft  July 2014 – 12 week consultation commenced  Sept 2014 – Consultation with Licensing Committee  Oct 2014 – Close of consultation (5 th )  Nov Final Policy to Cabinet  Dec 2014 – Approval at Council  January 2015 – Publication of new policy Timetable

 How has the policy changed since 2011?  Section 1 – Clearer Guidance on the cross overs between Licensing and Planning  Section 6 – More clarity on how we share information gained as a result of applications being submitted  Section 8 – The changes to how we enforce against licensed premises are more closely aligned to the enforcement policy and designed to be more directed and business friendly. What’s Different?

 How has the policy changed since 2011?  Section 9 – The Race Relations Act has been replaced by the Equality Act.  Section 14.6 – Petrol Station Fore-Court shops are becoming move prevalent as alcohol retailers. Guidance on the expectations on applicants has therefore been included  Section 15 – The Act was changed to remove ‘interested parties’ and add ‘Any Person’ and to remove the vicinity test. What’s Different?

 How has the policy changed since 2011?  Section 15 – More clarity for those making representation as to what happens to their data.  Section 16 – The Government changed the threshold for committees attaching conditions from ‘need’ to ‘appropriate’ to the promotion of the licensing objectives  Section 18 – Reviews. In line with the increase in the number of reviews the Authority has given a clearer view of its expectations. (Previous policy too bland) What’s Different?

 How has the policy changed since 2011?  General – Inclusion of the Licensing Authority and Health Authority as Responsible Authorities. Specific details about the role of the Licensing Authority are outlined in Sections 14 and 18  Appendix B – In the interests of transparency, the publication of the scheme of delegations has been included for the first time What’s Different?
