Sustainable Acquisition  This is the newest name for Green Purchasing  Established in the FAR in 2011 by FAR Case  Consists of several separate programs  Developed over several years  These are the parts making up the sustainable acquisition program 2

3 Background  Resource Conservation and Recovery Act of 1976 at Section 6002 established the Affirmative Procurement Program allowing EPA to designate products which Federal agencies would be required to acquire with recycled content  Farm Security and Rural Investment Act of 2002 established the Biobased Products Procurement Preference Program allowing USDA to designate products which Federal agencies would be required to acquire with biobased content

4 Background  Federal Acquisition Regulation was amended 11/07/2007 to add the Biobased Preference Program to the Affirmative Procurement Program so it became a program allowing EPA and USDA to designate products that Federal agencies are required to acquire with recycled or biobased content  Federal Acquisition Regulation was amended on 5/31/2011 to implement EO and Agencies are required to ensure that 95% of new contract actions are green

5 Sustainable Acquisition DOE includes:  EPA Designated Items and USDA Designated Biobased Items plus:  Energy Efficiency Programs  EnergyStar and FEMP  Alternative Fuels and Alternative Fueled Vehicles  Non-Ozone Depleting Substances  Water Efficiency Program i.e. WaterSense  Electronic Products Environment Assessment Tool (EPEAT) Program  Sustainable Design/Green Buildings

8 Environmentally Preferable Purchasing  Environmentally preferable products or services have a lesser or reduced effect on human health and the environment when compared with competing products or services that serve the same purpose

9 Environmentally Preferable Products Include All of These  Alternative fuel vehicles and alternative fuels required by the Energy Policy Act of 2005 at  Biobased products designated by the U.S. Department of Agriculture in the BioPreferred program. 10 Environmentally Preferable Products Include All of These  Energy Star® products identified by DOE and EPA at as well as FEMP- designated energy-efficient products at  EPEAT-registered electronic products. 13 Environmentally Preferable Purchasing Environmentally preferable products or services do one or more of the following:  Minimize the consumption of resources, energy and water  Prevent the creation of solid waste, air pollution or water pollution  Minimize or eliminate the use of materials or processes which compromise the environment (global warming, ozone depletion and acid rain)  Promote the use of non-toxic substances and avoid toxic materials or processes

14 Exemptions   According to both statutes, procuring agencies must procure the designated products unless the product: Is unavailable at a reasonable price Will not meet reasonable performance standards Is unavailable within a reasonable timeframe at a sufficient level of competition Price Performance Availability
