What are secondary sources?  Basics  Best uses for secondary sources:  Unfamiliar areas of law.  Looking for primary persuasive authority and you aren’t sure which jurisdictions to search.  Questions of first impression.  Initial search of primary law is ineffective (too much or too little).

When NOT to use secondary sources  Typically not appropriate to cite in legal briefs or memoranda of law (though, there are exceptions).  Ensure analyses of primary law are accurate.

What authority do secondary sources have? 1 Types of AuthorityMANDATORY (BINDING) PERSUASIVE (NON-BINDING) PRIMARY The LAW. Consists of constitutional provisions, statutes, and regulations in force within a specific jurisdiction. Primary law is always mandatory/binding in the jurisdiction in which it is in force. In the same jurisdiction, decisions from higher courts are mandatory on lower courts. Decisions from courts within one jurisdiction are persuasive authority for courts within another jurisdiction. In the same jurisdiction, lower court decisions are persuasive on higher courts. SECONDARY Anything NOT the law. Often provides commentary or analysis on the law. NEVER mandatory.Secondary authority can be used persuasively.

Legal Encyclopedias  Very Broad.  General background knowledge/citations to primary sources.  No commentary.  Examples: American Jurisprudence Second Edition (Am. Jur. 2 nd ) and Corpus Juris Secundum (C.J.S.).  Cite: ALWD Manual Rule 26, Bluebook Rule 15.8.

Treatises  In-depth treatment of single subjects.  Some commentary.  Cite: ALWD Manual Rule 22, Bluebook Bluepages B8.

ALR/ALR Federal  In-depth treatment of a narrow topic.  Provides cases on both sides of a legal issue.  Useful to find persuasive or mandatory authority.  Cite: ALWD rule 24 and Bluebook Rule

Legal Periodicals/Law journal articles  In-depth treatment of fairly narrow topics.  Extensive footnotes.  Print: Westminster Law Library: Index to Legal Periodicals.  Electronic: Westlaw, LexisNexis, HeinOnline, LegalTrac, Google Scholar, and many other databases.  Cite: Rule 23 in the ALWD Manual and B9 and Rule 16 in the Bluebook.

Looseleaf Services  Contains a variety of types of information concerning specific areas of law  Very desirable because of their currency.  Contains both primary and secondary law: be sure not to confuse these types of authority.

Restatements  In-depth, analytical treatment of broad areas of law.  Restatements “restate” CL rules of subjects.  Highly regarded as persuasive authority.  Cite: Rule 27 in the ALWD Manual and Rule 12.8 in the Bluebook.

Uniform Laws and Model Acts  Proposed model statutes that can be adopted by legislatures.  Exist in areas of law governed by statutes.  Do not take on the force of law unless a legislature adopts them.  Cite: ALWD Rule 27 and Bluebook 12.8.
