ACTION PLAN: “CREATION OF A SUBSIDIARY COMPANY FOR PEOPLE WITH DISABILITIES (PWD´S) INTO THE REPUBLIC OF ECUADOR” MISHEL ALVAREZ JICA PARTICIPANT FROM THE NATIONAL COUNCIL FOR THE EQUALITY OF DISABILITIES OF THE REPUBLIC OF ECUADOR

National Regulations for the Labor and Productive Inclusion of PWD´s in Ecuador Art. 47 Labor Cuota 4% labor quota for Persons with Disabilities (1 per every 25 ), was applied in the country with possibility of using a substitutes in specific cases and which can never surpass the 50% of the total hiring percentage. Art. 48 Substitutes "The relatives up to fourth degree of consanguinity and second of affinity, spouse, partner in de facto union, legal representative or persons under their responsibility and / or care for a person with severe disability, may be part of the percentage of compliance with labor inclusion, in accordance with the regulations. This benefit may not be transferred to more than one (1) person per person with a disability. Art. 51. Labor stability People with disability, deficiency or disabling condition will enjoy special stability at work. In the case of unjustified dismissal of a person with disability or whoever is responsible for the maintenance of the person with disability, must be compensated with a value equivalent to eighteen (18) months of the best compensation, in addition to the legal compensation Basic Salary $394 15 Basic Salaries $ 5.910 Art 116.- Very serious infractions. A pecuniary sanction of ten (10) to fifteen (15) unified basic remunerations of the private worker to not comply with the percentage of labor inclusion established in this law;

Objectives and Target Population LONG TERM OBJECTIVE PWD Conform the work force of the companies and be fully included in the labor market SPECIFIC OBJECTIVE To create a Subsidiary factory in joint group with the private sector in order to increase the participation of PWD PROJECT PERIOD 2 years for the creation and establishment of a pilot subsidiary company. TARGET AREA AND POPULATION: PWD of the city of Quito. 20 People with disabilities Objectives and Target Population

2021 Propose: Creation of a subsidiary company PWD Find Companies that are paying fees (5.910) for not having PWD in their Staff and let them know about subsidiary company OPTION 1 SUBSIDIARY 04 03 02 01 RETIRED SUPERVISOR OF ONE OF THE COMPANIES SUPERVISOR OF DAILY CARE CENTER SUBSTITUTE AS COORDINATOR OF THE PROGRAM OPTION 2 Find those companies with more than one hundred employees so that people with disabilities can work in the subsidiary company. OPTION 3 Find those services that are necessary in the State and contract PWD to carry out the activities through the subsidiary.

STRATEGIES TRAINING, IMPLEMENTATION AND MONITORING PROCESS NEGOTIATION PROCESS PROMOTE SOCIAL RESPONSIBILITY AND ENCOURAGE THE IDEA OF SUBSIDIARIES IN PRIVATE/ PUBLIC COMPANIES

1. STRATEGY: PROMOTE SOCIAL RESPONSIBILITY AND ENCOURAGE THE IDEA OF SUBSIDIARIES IN PRIVATE/ PUBLIC COMPANIES Activity 1: Use tool Inspector 2.0 to find those companies that are paying fees and those who have more than 100 employees. The Ministry have the software to find companies Ministry of Work Its my work to create the survey CONADIS Activity 2: Do a Survey to find small task that PWD could do in Private and Public companies Activity 3: Develop the idea of subsidiaries as a new way of labor inclusion for PWD Interinstitutional work to determine the process of the subsidiary CONADIS AND MINISTRY OF WORK Activity 4: Call a meeting to companies that were found ; apply the survey and give a lecture about subsidiaries Invite and give the seminar CONADIS 6 Months Activity 5: Compile the results and have a list of those companies that could form part of the Pilot Plan of Subsidiaries CONADIS My Job RISK Create to much expectation about subsidiary company and that Private Sector Institutions are not interested.

2. STRATEGY: NEGOTIATION PROCESS Activity 1: Negotiation of labor conditions- Schedules, production levels, wages The Ministry of work has to create a code or a manual Ministry of Work Activity 2: Define the mechanisms of intervention, development and control Activity 3: Definition of benefits and further conditions related to the construction of Subsidiary Companies 6 Months RISK The Ministry could have other affairs and don’t care about this process.

STRATEGY 3: TRAINING, IMPLEMENTATION AND MONITORING PROCESS Activity 1: Determinate the location of the subsidiary company And negotiate the benefits for the companies. CONADIS/ Ministry of Work/ PUBLIC AND PRIVATE COMPANIES Activity 2: Find the Staff and give Specialized Training. 1 YEAR Activity 3: Monitoring $25.000 RISK Delay of the process to accomplish the creation of the subsidiary. Difficulty of coordination with the different institutions.

Mitigation Strategies Do a draft with the advocacy theme about the subsidiary mechanism. Active role in the coordination of the strategies. Use the relation with private companies to engaged them in the process. Use the political power as a tool to develop this project. MITIGATION STRATEGY
