Request: Address: 211 Jennifer Lane Neighborhood: Brentwood Applicant: Rodrigo Gomez Lopez Lot area: 9,147 square feet Zoning: Single and Two-Family Residential (R-2) district Request: a variance to the side yard setback for principal structures to allow for construction of a two (2) stall attached garage on the north end of the home. Background: The property has an existing single stall garage attached to the south end of the home that is no longer used for its intended purpose. Several surrounding properties have principal structures that encroach on the side yard setback. Siting a two (2) stall garage anywhere on the lot would either require a variance or potentially alter the character of the neighborhood. The Zoning Ordinance permits principal structures to be located a minimum of 8’ from the interior side lot line. The proposed variance request will result in a 50% reduction of this requirement, or 4’ of separation between the principal structure and the side lot line. Laura

Comprehensive Plan: There are two (2) objectives for residential neighborhoods in the Comprehensive Plan. Encourage the continued maintenance and quality of existing neighborhoods. The proposed use is consistent with this objective. Minimize the development of incompatible land uses adjacent to residential land uses. The proposed use is consistent with this objective.
Planning Commission Recommendation: Approval Findings: The variance will allow the applicant to use the land in a reasonable manner which is consistent with the City’s Comprehensive Plan. The plight of the landowner is due to circumstances unique to the property not created by the landowner. The variance is not anticipated to negatively impact the essential character of the neighborhood. The variance is in harmony with the general purpose and intent of the zoning ordinance. Conditions of Approval: The driveway surfacing must be in conformance with the provisions of City Code Section 154.224 E. The applicant must submit an asbuilt survey indicating a distance of no more than 4’ between the exterior sidewall and the northern property line. The exterior building materials and colors of the garage match those of the home. The applicant must obtain all necessary permits for construction. Laura Need to change purpose of the district
