Crimes Against the Person Criminal Homicide First Degree Murder - Committed with Malice (having intent to kill) and premeditation Felony Murder – Any killing that takes place during the commission of certain felonies (i.e. rape, burglary) Most states consider this first degree murder even without Premeditation or malice
