Crimes Against the Person Criminal Homicide First Degree Murder - Committed with Malice (having intent to kill) and premeditation Felony Murder – Any killing that takes place during the commission of certain felonies (i.e. rape, burglary) Most states consider this first degree murder even without Premeditation or malice
Crimes Against the Person Criminal Homicide Second degree murder - Committed with malice but without premeditation Voluntary manslaughter – Occurs after the victim has committed an act that would cause a reasonable person to lose self control(Heat of passion). Cannot be provoked by words alone. Must occur before a “cool down” period.
