Crime against the person involve physical harm Included in the Crimes Act 1958 Include homicide, rape, assault, kidnapping

3 Homicide Homicide is the killing of a human being by another
Unlawful homicides include; Murder Manslaughter Defensive homicide Culpable driving Infanticide

4 Lawful homicides include;
Self-defence- only reasonable force must be used Act of war- soldier killing another soldier during a time of war Carrying out a sanctioned death sentence- in countries with the death penalty Through enforcing justice, e.g. by a police officer Accident through no reckless or unlawful activity

6 Murder Most serious type of homicide
A person intentionally or recklessly kills another person Inflicts a severe injury and a person dies as a result Carries a maximum of life imprisonment (Crimes Act 1958)

7 Murder (cont.) The following must be established for a guilty verdict;
Killing was unlawful Malice aforethought existed (guilty mind, intended to commit the crime, planned) Accused was responsible for the death Victim was human Accused was of sound mind Accused was 10 years or over (age of criminal responsibility)
