Patents “Route Based on Distance” (Patent No. 7,627,423 Filed: March 10th, 2005) Portable device for generating a route using waypoints Incorporation of elevation data in user-defined route

Patents “Navigation device, method, and program” (Patent No. 7,565,240 Filed: November 28, 2005) A device using of waypoints for GPS navigation A device for providing guidance from a given starting point to a user selectable destination

Commercial Products Flaik Sports Armband Wearable navigation device for snowsports Utilizes GPS data to track ski/snowboard trips throughout the day No known patents on the device

Differentiation Different from patent 1 in that it is not utilized for running and meant to be used exclusively off-road Different from patent 2 in that it is a personal navigation device and not used for vehicle applications No known patents for Flaik sports armband, so infringement is not currently an issue

Dealing with Potential Liability Patent 1: License the patent, or challenge it based on the fact that it appears to be trivial Patent 2: Challenge the patent based on the fact that it doesn’t appear to be novel (existing prior art that patent doesn’t seem to step away from significantly)
