Update on (draft) implementing acts (IA) ESF Technical Working Group Athens, 18 June 2014

I. IA adopted by the Commission and published in the OJ IA on the OP models (for IGJ goal and ETC) – Regulation (EU) No 288/2014 IA on SFC and on categorisation for ETC - Regulation (EU) No 184/2014 IA on the performance framework, climate change tracking and categorisation - Regulation (EU) No 215/2014

II. IA in the pipeline and expected timetable - Second wave of IA IA on financial instruments (modalities of transfer and management of programme resources; report on implementation); information and communication; functions of the MA: system to record and store data on each operation - technical specifications Submitted to COESIF for meetings on 4 and 25.06.2014 (examination procedure – no opinion – no action) Expected entry into force : July Initially planned for COESIF 30 April

IV. Update on state of play of delegated acts (1) 2 DA have been adopted by the Commission: European Code of Conduct on Partnership (Regulation (EU) No 240/2014) DA supplementing the CPR covering i.a. financial corrections under the performance framework, financial instruments, flat rate for indirect costs and the related methods applicable to other Union policies, information to be recorded and stored in computerised form within the monitoring system, etc. (Regulation (EU) No 480/2014)

IV. Update on state of play of delegated acts (2) DA in the pipeline: PPP: additional rules on the replacement of a beneficiary and related responsibilities + minimum requirements for the application of Art. 64(1) CPR (empowerments of Art. 63(4) and 64(4) CPR): transmission to EP and Council foreseen in 2nd half of 2014 Irregularities to be reported, data to be provided, conditions and procedures to determine whether irrecoverable amounts will be reimbursed (empowerment of Art.122 (2) sub-para 5 CPR): transmission to EP and Council foreseen in 2nd half of 2014

IV. Update on state of play of delegated acts (3) DA in the pipeline: Revenue generating operations: (empowerment of Art. 61(3) sub-para 3 CPR): transmission to EP and Council foreseen after 2014 Simplified costs options: requests made by IT, AT and SE (empowerment of Art. 14(1) ESF Regulation): transmission to EP and Council foreseen for November-December 2014
