Part 4 - Minority and Small Businesses 2CFR 200.321 7CFR 226.22(f) 7CFR 225.17(d) Welcome to the ODE CNP Procurement training, Part 4-Minority and Small Businesses. This provisions applies to all sponsors participating in Child Nutrition Programs.

Minority and Small Businesses Must use Affirmative Steps when possible: Inclusion on solicitation lists Solicited when potential sources Dividing total requirements when feasible Establishing delivery schedules to encourage participation Use Small Business Administration and Minority Business Development Agency If subcontracting, subcontractors follows steps 1-5 2 CFR 200.321 gives provisions for contracting with small and minority businesses and women’s business enterprises. Additionally, program specific regulations for CACFP and SFSP have provisions for minority and women’s businesses. Sponsors must take all necessary affirmative steps to assure that minority businesses and women’s business enterprises are used when possible. The affirmative steps must include: (click)Placing qualified small and minority businesses and women’s business enterprises on solicitation lists; (click)Assuring that small and minority businesses and women's business enterprises are solicited whenever they are potential sources (click)Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by small and minority businesses and women’s business enterprises (click)Establishing delivery schedules, where requirement permit, which encourage participation by small and minority businesses, and women’s business enterprises (click)Using the services and assistance, as appropriate, of such organizations as the small Business Administration and the Minority Business Development Agency of the Department of Commerce (click)Requiring the prime contractor, if subcontracts are to be let, to take the affirmative steps listed in 1-5

By searching this webpage for your town, city or county, you will be able to determine if there are minority, women or emerging small businesses, which should be included on your solicitation lists. Clicking on the link in this slide will take you to the webpage pictured on the slide. (click) Click on the Directory of Certified Firms in the green box at the right.

Using the Office for Business Inclusion and Diversity You will next see a page to conduct a search. The first step is to search by Commodity Code (click)

Using the Office for Business Inclusion and Diversity When you click on “Lookup Commodity Code” you will see a search page like what is pictured on this slide. Next click on “Browse Codes”

Using the Office for Business Inclusion and Diversity A listing of commodity codes will appear.

Using the Office for Business Inclusion and Diversity Scroll down the list until you find “Accommodation and Food Services”. The code number is 72 . By clicking on the number “72” you will be able to drill down to more specific Food service contractors.

Using the Office for Business Inclusion and Diversity The first time you click on code # 72 you will see two additional choices. Code #722 is for Food services and Drinking places. When you click on code #722 you will see additional choices. Code #7223 is for Special Food Services. Click on Code #7223 and another list of Food Service Contractors, Caterers and Mobile Food Services will pop up. Code # 722310 if for Food Service Contractors. Click on “Add” to select this code.

Using the Office for Business Inclusion and Diversity When you choose Code #722310 by clicking “Add” you will return to the original search document. Now search by location. When you type in “Salem” and click search, the results show there are no matches. In other words, there are no minority, women or emerging small businesses that are food service contractors. Therefore, you will not add a minority, women or small business to your solicitation list. Print and save documentation as evidence that you did try to search for these type of businesses.

Using the Office for Business Inclusion and Diversity If your location is in Portland, Multnomah County, you will see that there are two vendors. You would need to investigate whether these two vendors will meet your need as a supplier. If they do not, then you do not need to add these vendors to your solicitation list.
